(z>20)3- S <br />LEE COUNTY <br />Committed Today for a Better Tomorrow <br />RESOLUTION BY THE LEE COUNTY BOARD OF COMMISSIONERS REQUESTING CLARIFICATION AND <br />CONTINUANCE OF CHILD SUPPORT EXEMPTION FROM FILING FEES PERTINENT TO MOTIONS FILED IN <br />CHILD SUPPORT ACTIONS <br />(Original Proposed House Bill 343 and Senate Bill 385) <br />WHEREAS, a technical amendment to the 2011 -2012 State budget granted the Child Support Program <br />an exemption from paying filing fees for certain motions filed in cases receiving services from the <br />program; and, <br />WHEREAS, NC Senate Bill 385 and the original HB 343 will replace the waiver by requiring all counties <br />to pay all court filing fees in advance and the counties will no longer be exempt from any court filing <br />fees; and, <br />WHEREAS, the language in that bill could be construed to allow relief from these fees only in motions <br />filed under G.S.110 and Court Orders for Child Support are initiated by the Child Support program <br />under G.S. Chapters 49, 50 and 110; and, <br />WHEREAS, there is a need to clarify that the exemption from paying these filing fees is not limited to <br />actions filed under Chapter 110, but applies to all actions initiated by the IV -D Agency in cases <br />receiving program services and to extend the exemption with no expiration date; and, <br />WHEREAS, counties will be greatly impacted by this cost in their budgets; and, <br />WHEREAS, the County Finance office will be burdened with the responsibility to oversee transfer of <br />funds between county accounts, with no actual increase or decrease in county funds; and, <br />WHEREAS, this bill will have a huge impact on the performance of the child support service's staff and <br />will also reduce collections of child support for the families. <br />NOW, THEREFORE, BE IT RESOLVED that the Lee County Board of Commissioners strongly <br />opposes changes to G.S. 7A- 305(f) and G.S. 7A -308 as contained in proposed House Bill 343. <br />BE IT FURTHER RESOLVED that copies of this resolution is transmitted to members of the General <br />Assembly representing Lee County to let them know of our concerns. <br />Adopted this 5 th day of May 2013. <br />ATTEST: <br />f <br />Charles T.
