o� 013- ) 0 <br />L EE COUNTY <br />Committed Today for a Better Tomorrow <br />RESOLUTION AND ORDER <br />MAKING FINDINGS CONCERNING THE ESTABLISHMENT OF SEVEN FIRE AND EMERGENCY <br />RESPONSE SERVICE DISTRICTS WITHIN THE EXISTING RURAL FIRE PROTECTION DISTRICTS OF LEE <br />COUNTY AND DIRECTING STAFF TO TAKE ALL ACTIONS THAT WILL ALLOW THIS BOARD TO MAKE <br />A FINAL LEGAL DECISION CONCERNING WHETHER TO ESTABLISH THE SAME <br />WHEREAS, in order to improve the fire protection class ratings when the new annual ratings <br />are established, officers of the Fire Advisory Board, property owners, residents and the seven Rural <br />Fire Protection Districts in Lee County, have requested this Board transfer by July 1, 2013 the <br />responsibility of providing fire protection services and emergency medical response in each of Lee <br />County's seven districts from Rural Fire Protection Districts to Rural Fire Service Districts, and; <br />WHEREAS, officers of the seven districts in Lee County and the Lee County Fire Advisory <br />Board have considered other options to provide fire protection services and emergency medical <br />response to the seven Rural Fire Protection District areas that would improve the fire protection <br />class rating and recommend transferring services from the fire protection districts to fire service <br />districts, and; <br />WHEREAS, this Board has received and considered information that the County's contracts <br />with the Fire Departments of the Tramway Rural Fire Protection District, the Deep River Rural Fire <br />Protection District, the Cape Fear Rural Fire Protection District, the Northview Rural Fire Protection <br />District, the Lemon Springs Rural Fire Protection District, the Carolina Trace Rural Fire Protection <br />District, and the Northwest Pocket Rural Fire Protection District not only requires each district's Fire <br />Departments to provide fire protection services but also requires each Department to provide <br />emergency medical response; and, <br />WHEREAS, this Board received and considered information that the only action that could <br />result in placing every parcel in the unincorporated portion of Lee County within a rated fire district <br />is through the establishment of seven service districts within the existing Tramway Rural Fire <br />Protection District, Deep River Rural Fire Protection District, Cape Fear Rural Fire Protection District, <br />Northview Rural Fire Protection District, Lemon Springs Rural Fire Protection District, Carolina Trace <br />Rural Fire Protection District, and Northwest Pocket Rural Fire Protection District, pursuant to <br />Chapter 153A, Article 16, Part 1 of the North Carolina General Statutes; and, <br />WHEREAS, the seven proposed service districts would not be municipal corporations and <br />would have no independent authority but, rather, would be established and maintained by the <br />County, under the control of this Board; and, <br />WHEREAS, as required by North Carolina General Statute § 153A -302, this Board received <br />and considered information and evidence from the Fire Advisory Board, the property owners who <br />would be affected by creation of the proposed fire protection, ambulance and rescue service <br />1 <br />
