BRITT <br /> REGISTER OF DEEDS <br /> FILED Apr 17, 2023 <br /> AT 11:24:22 am <br /> BOOK 00003 <br /> START PAGE 0916 <br /> END PAGE 0917 <br /> INSTRUMENT# 02218 <br /> EXCISE TAX (None) <br /> Resolution of the Lee County Board of Commissioners <br /> Consolidating the Lee County Health Department and the <br /> Lee County Department of Social Services into the <br /> Lee County Consolidated Human Services Agency <br /> WHEREAS,in 2012,the North Carolina General Assembly adopted House Bill 438, amending <br /> North Carolina General Statutes 153A-77 and 153A-76, granting counties the ability to create a <br /> Consolidated Human Services Agency; and <br /> WHEREAS,North Carolina General Statute 153A-77 allows counties the option to appoint a <br /> Consolidated Human Services Board to serve as the governing board of the Consolidated Human <br /> Services Agency and gives counties the flexibility and authority to organize human services in <br /> such a way as to promote efficiency and effectiveness in the administration of human services <br /> and to strengthen the local public health infrastructure; and <br /> WHEREAS, the Lee County Board of Commissioners finds that consolidating the Lee County <br /> Health Department and the Lee County Department of Social Services into a Consolidated <br /> Human Services Agency is beneficial to the Lee County Health Department and its staff and the <br /> Lee County Department of Social Services and its staff, and most importantly to the citizens of <br /> Lee County; and <br /> WHEREAS,the Lee County Board of Commissioners, pursuant to North Carolina General <br /> Statue 153A-77, finds that upon such consolidation, it is in the best interest of the Lee County <br /> that a Consolidated Human Services Board be created to serve as the policy making, rulemaking, <br /> and administrative board of the Consolidated Human Services Agency, and that the Consolidated <br /> Human Services Director and all Agency staff/employees, operate under the personnel policies of <br /> Lee County, subject to the nine principles of the Federal Merit System, and work at the discretion <br /> of and under the supervision of the County Manager in accordance with North Carolina General <br /> Statute 153A-77(e). <br /> NOW,THEREFORE BE IT RESOLVED,by the Lee County Board of Commissioners the <br /> following, in sequential order: <br /> 1. The Lee County Government staff review, update, and amend the Lee County Personnel <br /> Policy to ensure any changes that need to be made to move the Department of Social <br /> Services and the Health Department employees under all aspects of the Lee County <br /> Personnel Policy and to ensure it meets the nine principles of the Federal Merit System, <br /> and any changes be adopted before the Consolidated Human Services Agency takes effect <br /> on July 12, 2023. <br /> 2. Employees who serve as staff of the Consolidated Human Services Agency will be <br /> subject to the Lee County Personnel Policy and ordinances and will no longer be subject <br /> to the North Carolina Human Resources Act effective July 12, 2023. <br />
