BRITT <br /> REGISTER OF DEEDS <br /> FILED Jul 13, 2022 <br /> AT 03:34:58 pm <br /> BOOK 00003 <br /> START PAGE 0837 <br /> END PAGE 0837 <br /> INSTRUMENT # 05439 <br /> EXCISE TAX (None) <br /> RESOLUTION AUTHORIZING THE DISPOSAL OF EQUIPMENT AS SURPLUS <br /> PROPERTY THROUGH ONLINE PUBLIC AUCTION <br /> WHEREAS, the County of Lee owns equipment, as described on Attachment A, that are <br /> surplus to its needs; and, <br /> WHEREAS, the County of Lee will only accept bids above the minimum of$6,000 for <br /> equipment described on Attachment A; and, <br /> WHEREAS, North Carolina General Statute 153A-176 and 160A-270 allows the County <br /> to sell personal property at public auction upon approval of the Lee County Board Of <br /> Commissioners and after publication of a notice announcing the auction; and, <br /> NOW, THEREFORE, BE IT RESOLVED by the Lee County Board of Commissioners <br /> as follows: <br /> 1. The Lee County Board of Commissioners hereby authorizes the sale at public auction <br /> the equipment as listed on Attachment A. <br /> 2. The Lee County Board of Commissioners authorizes the auction to be conducted <br /> through the County's website, by means of sealed bid. <br /> 3. Notice of auction will be published at least ten (10) days before the auction is <br /> conducted. <br /> 4. The auction will be advertised on the County's website for a minimum of seven(7) <br /> days. <br /> 5. The terms of the sale are that the property is sold in its current condition, as is, and <br /> the County gives no warranty with respect to usability of the property. <br /> 6. That the buyer will pay the full amount of his or her bid within five(5)business days <br /> of the conclusion of the auction. Failure to make payment within five(5)business <br /> days of the auction cancels the buyer's bid. <br /> 7. That the County reserves the right to withdraw any listed property from the auction at <br /> any time before the auction sale of that property. <br /> 8. That the County requires the buyer to remove equipment within thirty(30) days of the <br /> conclusion of the auction. Failure to remove the equipment within thirty(30) will <br /> result in the forfeiture of the auction property. <br /> 9. That the County requires the buyer to remove equipment by a county approved <br /> contractor once proof of a certificate of insurance has been provided to the County. <br /> Dated this the 16th day of May 9(IY) //din_. 1 �. <br />
