♦fit ., A <br /> 1110 ' mos <br /> ‘e7: 0•S7- <br /> RESOLUTION OF THE LEE COUNTY BOARD OF COMMISSIONERS <br /> IN SUPPORT OF LEGISLATION LIMITING MUNICIPALITIES FROM USING PUBLIC <br /> UITILITES TO FORCE SATELLITE ANNEXATIONS <br /> WHEREAS, residential, commercial, and industrial developers are interested in developing property in <br /> the unincorporated areas of Lee County; and <br /> WHEREAS, said anticipated development will bring economic investment and jobs to the Lee County <br /> area; and <br /> WHEREAS, said developers may seek to extend water and sewer utilities in the unincorporated areas at <br /> their own expense and do not seek to be annexed by a municipality; and <br /> WHEREAS, the recent law passed by the General Assembly that allows annexation of property beyond <br /> 3 miles of the current city limits of Sanford no longer restricts the ability of the municipality to force annexation <br /> using public utilities as a tool for annexation and is creating service issues for police and fire services; and <br /> WHEREAS, in order to facilitate economic development in the unincorporated areas of Lee County and <br /> other Counties throughout the State, the Commissioners seek action on this issue from the North Carolina <br /> General Assembly. <br /> NOW, THEREFORE, BE IT RESOLVED, that the Lee County Board of Commissioners hereby <br /> requests that the North Carolina General Assembly address the issue of forced annexation by utility extensions <br /> and ask that they impose any law necessary to ensure the fair treatment of citizens and developers who are <br /> willing to extend utilities at their own expense and to pay higher user fees by not being in an incorporated <br /> district; and <br /> The Commissioners request that the Clerk to the Board of the Lee County Board of Commissioners <br /> forward this resolution to the State Legislative Delegation of Representative John Sauls and Senator Jim <br /> Burgin; and <br /> The Commissioners further request that this resolution be forwarded to the North Carolina County <br /> Association of County Commissioners seeking that this matter become a legislative goal of the Association in <br /> the upcoming legislative session. <br /> Adopted this p?16+ day of September, 2020. <br /> LEE COUNTY BOARD OF CdOMMISSIONERS <br /> BY t,/"1/f�'`� _��?�t4� <br /> Amy Dalrymple, Chair <br /> ATTEST: <br /> - / lona <br /> nifer 1, . ble, Clerk <br />
