RESOLUTION BY THE LEE COUNTY BOARD OF COMMISSIONERS REQUESTING THE LEE COUNTY BOARD OF ELECTIONS TO HOLD SEPARATE ELECTIONS IN THE TOWNSHIPS OF DEEP RIVER AND POCKET ON PROPOSITIONS CONCERNING THE SALE OF MALT BEVERAGES AND UNFORTIFIED WINE WHEREAS,North Carolina General Statute 18B-600(f) states that an election on any of the propositions listed in General Statute 18B-602(a), (d)and (h) may be called in any township located within a county where the population of all cities in the county that have previously approved the sale of any kind of alcoholic beverages comprises more than twenty percent(20%)of the total county population as the most recent federal census; and, WHEREAS, according to the last federal census the population of all cities in Lee County that have previously approved the sale of any kind of alcoholic beverage comprises fifty percent(50%)of the total county population; and, WHEREAS, the townships of Deep River and Pocket are located in Lee County and are eligible under the provision of General Statue 18B-600(f)to hold township elections concerning the sale of malt beverages and unfortified wines; and, WHEREAS,N.C.G.S. 163-287 states that if a county is seeking to call a special election, the governing board shall adopt a resolution specifying the details of the election; and, WHEREAS, the Lee County Board of Commissioners is requesting for the Board of Elections to hold a special elections on the propositions concerning the sale of malt beverages and unfortified wine, to take place during the 2020 general election to be held on November 3, 2020. NOW THEREFORE, BE IT RESOLVED,by the Lee County Board of Commissioners that the Lee County Board of Elections is hereby requested to conduct a special election on propositions concerning the sale of malt beverages and unfortified wines during the 2020 general election to be held on November 3,2020. The special election should be conducted for the townships of Deep River and Pocket on the following propositions: A. As to the sale of malt beverages: (1)To permit the"off-premises" sale only of malt beverages. O FOR El AGAINST B. As to the sale of unfortified wine: (1)To permit the"off-premises" sale only of unfortified wine. O FOR O AGAINST Approved this day of , 2020.
