County of Lee <br />Ordinance <br />Requiring a Criminal History Background Check <br />Of All Applicants for Lee County Government Positions <br />BE IT ORDAINED by the Board of Commissioners of the County of Lee <br />In an effort to protect Lee County from possible conduct which might be detrimental to the County or its property, <br />any person about whom the Sheriff has reliable information that said person has been convicted of a crime set out <br />in Subchapter IV, Offenses against the Habitation and Other Buildings and Subchapter V, Offenses Against <br />Property of Chapter 14, Criminal Laws of the North Carolina General Statutes shall not be offered employment with <br />the County. <br />In an effort to protect the County from conduct which might be detrimental to the individuals served by the County, <br />no person about whom the Sheriff has reliable information that said person has been convicted of a crime set out in <br />the following Subchapters of Chapter 14, Criminal Law of the North Carolina General Statutes. II. Offenses against <br />the State; III. Offenses against the Person, VII. Offenses against Public Morality and Decency shall not be offered <br />employment with the County in any position. Further, no individual who volunteers to participate in any youth sport, <br />youth activity or program sponsored by the County shall be approved as a volunteer if known by the Sheriff to have <br />been convicted of any misdemeanor or felony crimes listed in this paragraph. <br />In making a determination as to qualification for employment of persons about whom the Sheriff has reliable <br />information that said person has been convicted of a misdemeanor, the County may consider the following length <br />of time since conviction, nature of the crime, circumstances surrounding the commission of the offense or offenses, <br />evidence of rehabilitation, number of prior convictions, and age of the person at the time of occurrence. <br />In the event of a vacancy occurring in any County position, the Human Resources Director shall require any final <br />applicant for the position to provide fingerprints and /or all other necessary personal identification in order that the <br />Sheriff or his designee might cause a thorough search to be made of local and state criminal history records to <br />determine if the applicant has a history involving criminal conviction for any of the crimes enumerated in the <br />previous paragraphs of this article. The Sheriff or his designee shall cause a check for slate criminal history <br />records be made of all final applicants for any county position including volunteer positions. The Sheriff shall cause <br />all records to be forwarded to the Human Resources Director. <br />In the event that the Human Resources Director and the County Attorney find that a final applicant for a position <br />has a criminal history involving a conviction for one of the crimes in this article, the applicant shall be provided the <br />opportunity to challenge the accuracy of the information. Having done so, the Human Resources Director shall <br />indicate to the County Manager in writing whether or not the particular applicant for the position is approved If the <br />applicant is not approved, the Human Resources Director shall eliminate the particular applicant from further <br />consideration. <br />Adopted this the thirteenth day of August, 2007. <br />Attes; <br />Robert H.
