2009 - F <br />• RESOLUTION URGING THE CONGRESS OF THE UNITED STATES <br />TO OPPOSE ANY EFFORTS TO ADOPT THE EMPLOYEE FREE CHOICE ACT <br />a/k/a CARD CHECK LEGISLATION <br />WHEREAS, private ballot elections are a fundamental American right that ensures that <br />every voter expresses his or her choice without peer pressure and that the choice of the <br />majority prevails; and <br />WHEREAS, the Employee Free Choice Act will take this right away and will violate the <br />employee's right to privacy; and <br />WHEREAS, passing the Employee Free Choice Act will replace a federally supervised <br />private ballot election with a system whereby employees publicly sign cards (card check) <br />to vote on unionization; and <br />WHEREAS, the Card Check leaves employees vulnerable to harassment, <br />misinformation, and labor union pressure, because they publicly sign cards (card check) <br />to vote on unionization; and <br />WHEREAS, North Carolina is a right -to -work state with a low unionization rate which <br />leads to a favorable business climate; and <br />WHEREAS, the Employee Free Choice Act would have a significant negative impact on <br />• Lee County's small business community and our ability to recruit new industry; and <br />WHEREAS, small businesses are less likely to have labor counsel and are more <br />susceptible to the complicated legal restrictions employers face during union organizing <br />drives, and <br />WHEREAS, under the Employee Free Choice Act, through a "binding arbitration" clause <br />in the legislation, Card Check puts wage and benefit power in the hands of a <br />government bureaucrat rather than the employer /business owner and workers. <br />NOW, THEREFORE, BE IT RESOLVED BY the Lee County Board of <br />Commissioners that the members of Congress are urged to oppose any efforts to enact <br />the "Employee Free Choice Act" or any similar act aiming to remove the secret ballot <br />from the union organizing process or force mandatory arbitration for labor contracts. <br />BE IT FURTHER RESOLVED that the Chairman of the Lee County Board of <br />Commissioners is authorized and directed to transmit an appropriate copy of this <br />resolution to each member of our North Carolina Congressional Delegation. <br />Adopt thm day /of L .Y / 2009. <br />U c 1 _y 1_ <br />096 A.
