2011 - <br />LEE COUNTY <br />Committed Today for a Better Tornorrow <br />ORDER TO ADVERTISE <br />DELINQUENT 2010 REAL PROPERTY TAX LIENS <br />WHEREAS, North Carolina General Statute § 105 -369 requires the county tax collector <br />to report to the governing board on the first Monday in February the total amount of unpaid <br />taxes for the current fiscal year that are liens on real property; and <br />WHEREAS, upon receipt of the report the governing body must order the tax collector <br />to advertise the tax liens in accordance with North Carolina General Statute § 105- 369(c); and <br />WHEREAS, North Carolina General Statute § 105 -369 defines district taxes collected <br />by the county tax collector as county taxes for purposes of advertisement; and <br />WHEREAS, North Carolina General Statute § 105 -369 allows the tax collector to <br />assess a fee to cover the actual cost of advertisement on any reasonable basis. <br />• NOW, THEREFORE BE IT RESOLVED that the Lee County Board of Commissioners <br />does hereby order the Lee County Tax Collector to advertise all unpaid 2010 taxes that are a <br />lien against real property and assess an advertising fee as allowed by statute. <br />NOW, THEREFORE BE IT FURTHER RESOLVED that the Lee County Board of <br />Commissioners also orders the Lee County Tax Collector to provide due process to each <br />taxpayer as required by North Carolina General Statute § 105 -369. <br />Adopted this 7' day of February 2011.
