2011 - // <br />LEE COUNTY <br />©o0Qa (3 as 9 a0© <br />• Committed Today for a Better Tomorrow <br />RESOLUTION AND ORDER <br />MAKING FINDINGS CONCERNING THE ESTABLISHMENT OF TWO FIRE, AMBULANCE AND <br />RESCUE SERVICE DISTRICTS WITHIN THE EXISTING CAPE FEAR RURAL FIRE PROTECTION <br />DISTRICT AND DIRECTING STAFF TO TAKE ALL ACTIONS THAT WILL ALLOW THIS BOARD TO <br />MAKE A FINAL LEGAL DECISION CONCERNING WHETHER TO ESTABLISH THE SAME <br />WHEREAS, a majority of the property owners and residents in the Clearwater Drive <br />residential community have petitioned this Board to transfer by July 1, 2011 the responsibility <br />of providing fire protection services in the area from the Cape Fear Rural Fire Protection District <br />to the City of Sanford with the purpose of improving the area's fire protection class rating when <br />the new annual ratings are established, and; <br />WHEREAS, this Board has received and considered information from the County <br />Attorney that the County's contract with the Cape Fear Fire Department not only requires the <br />Department to provide fire protection services but also requires it to provide ambulance and <br />rescue services, and; <br />• WHEREAS, the Law and Finance Committee of the Sanford City Council at its April 13, <br />2011 meeting expressed, by consensus opinion, support for the petition and the availability and <br />willingness of the City of Sanford and the Sanford Fire Department to provide fire protection, <br />ambulance and rescue services to the Clearwater area similar to that provided to property <br />owners and residents within the city limits for approximately $36,000 during Fiscal Year 2010- <br />2011, which would improve the area's fire protection class rating, and; <br />WHEREAS, officers of the Cape Fear RFP District and the Lee County Fire Advisory Board <br />have considered and presented to this Board other options to provide fire protection, <br />ambulance and rescue services to the Clearwater area that would improve the area's fire <br />protection class rating, but expressed no preference concerning which option should be <br />implemented, and; <br />WHEREAS, this Board received and considered the County Attorney's opinion that the <br />only action that could result in transferring the responsibility to provide fire protection, <br />ambulance and rescue services in the Clearwater area from the Cape Fear Rural Fire Protection <br />District to the City of Sanford by the deadline sought by the Clearwater property owners is by <br />the establishment of two service districts in the exiting Cape Fear District, pursuant to Chapter <br />153A, Article 16, Part 1 of the North Carolina General Statutes, one for the Clearwater area and <br />the other for the remaining Cape Fear area, and; <br />• <br />1 <br />
