® KU 17 PAGE 499 <br />MINUTES OF THE MEETING <br />OF THE <br />LEE COUNTY BOARD OF COMMISSIONERS <br />IN THEIR CAPACITY AS THE GOVERNING BODY <br />OF THE <br />LEE COUNTY WATER AND SEWER DISTRICT NO. 1 <br />NOVEMBER 16, 1998 <br />A meeting of the governing body of the Lee County Water and Sewer District No. <br />J 1 was held in the Commissioners' Room, Lee County Government Center, 106 Hillcrest <br />Drive, Sanford, North Carolina, immediately following the regular meeting of the Lee <br />County Board of Commissioners held on said date. Commissioners present were Jimmie <br />M. Cox, T. Ervin Mansfield, Bertha L. Matthews, J. Douglas Moretz, Nathan E. Paschal <br />and Robert T. Reives. <br />Chairperson Matthews presided and Gaynell M. Lee, Clerk to the Board of <br />Commissioners, acted as Secretary of the meeting. <br />Commissioner Paschal moved to approve the consent agenda as printed, which <br />consisted of the following item: <br />■ minutes of the October 19, 1998 meeting <br />Commissioner Moretz seconded the motion, and upon a vote, the results were as follows: <br />Aye: Cox, Garner, Mansfield, Matthews, Moretz, Paschal and Reives <br />Nay: None <br />The Chairperson ruled the motion had been adopted unanimously. <br />Public Works Director Kenny Cole recommended the Board pursue damages <br />against Sanford Contractors due to the sixty-four (64) day overrun in the Phase I Water <br />Project. He told the Board the owner was entitled to damages of $200.00 per day plus <br />inspection cost incurred over the contract limit. A total of S24,640.00 in damages have <br />been recorded. After some discussion, Commissioner Reives moved to approve the <br />recommendation of the Public Works Director to pursue damages against Sanford <br />Contractors in the amount of $24,640.00 Commissioner Moretz seconded the motion, <br />and upon a vote, the results were as follows: <br />045 <br />
