LEE COUNTY <br />Committed Today for a Better Tomorrow <br />RESOLUTION AUTHORIZING SALE OF SURPLUS PERSONAL PROPERTY <br />WORTH LESS THAN $30,000 (G.S. 160A-266) <br />WHEREAS, as part of an incentive agreement, including a Golden LEAF Foundation Economic <br />Catalyst Grant, Lee County acquired and leased to Frontier Spinning approximately 8,500 plastic pallets used <br />for shipping yarn; and, <br />WHEREAS, per the terms of the Equipment Lease between Lee County and Frontier Spinning, the lease <br />of these pallets resulted in continued use of the North Carolina Ports, thereby increasing the number of jobs and <br />taxable investment in Lee County and North Carolina; and, <br />WHEREAS, said Equipment Lease expires on May 22, 2016; and, <br />WHEREAS, upon expiration of said Lease, Lee County will own all remaining pallets and such pallets <br />will be surplus to the needs of the County; and, <br />WHEREAS, the County desires to sell such pallets by private sale as authorized by North Carolina <br />General Statute § 160A -266(a) and (b), which statute permits the county to sell such property by private sale, upon <br />authorization by the Board of Commissioners at a regular meeting and notice to the public; and, <br />WHEREAS, the Lee County Board of Commissioners is convened in a regular meeting. <br />NOW, THEREFORE, BE IT RESOLVED by the Lee County Board of Commissioners as follows: <br />1. The pallets herein described are declared surplus to the needs of the County as of the date of <br />expiration of the Lease. <br />2. The County Manager is hereby authorized to sell the surplus pallets by private sale on or after May <br />22, 2016. <br />3. The Clerk to the Board of Commissioners shall publish a notice after May 22, 2016, summarizing <br />this Resolution, and no sale may be executed pursuant to this Resolution until at least 10 days after <br />the day the notice is published. <br />Sf <br />Dated this tl� day of March 2016. / <br />Amy M.
