LEE COUNTY <br />Committed Today for a Better Tomorrow <br />RESOLUTION AUTHORIZING THE ASSIGNMENT OF BID FOR PROPERTY LOCATED AT <br />851 EAGLES NEST DRIVE IN LEE COUNTY, NORTH CAROLINA <br />WHEREAS, Mary Yow, Lee County Tax Administrator, is responsible for collecting delinquent taxes, <br />including through forced collections and foreclosure proceedings, if necessary; and, <br />WHEREAS, on August 28, 2015, after due notice of foreclosure and the entry of a default judgment, <br />certain property owned by Russell Dennis, Jr., located at 851 Eagles Nest Drive in Lee County, North Carolina, <br />PIN 9660-90-0427-00, as shown on a deed recorded in Deed Book 1324, Page 592, in the office of the Register <br />of Deeds for Lee County, to which the record thereof reference is hereby made for more complete description, <br />was held for public sale at the Lee County Courthouse; and, <br />WHEREAS, Mark Bardill, Lee County foreclosure attorney, conducted said sale; and, <br />WHEREAS, due to no other bids being made, Lee County was the high bidder on the above-described <br />property in the amount of $2,189.52; and, <br />WHEREAS, after said sale but prior to confirmation by the court, the County was contacted by Mr. <br />Kenneth Garrett who requested that the County assign its bid to him in the name of KKG, LLC for the amount <br />of $2,189.52; and, <br />WHEREAS, North Carolina General Statutes §§ 101-376(a) and 160A-267 permit the county, as the <br />successfully bidder, to assign its bid by private sale for not less than the amount of the bid; and, <br />WHEREAS, the Lee County Board of Commissioners desires to assign such bid. <br />NOW, THEREFORE, BE IT RESOLVED by the Lee County Board of Commissioners as follows: <br />1. The Lee County Board of Commissioners hereby accepts Mr. Garrett's request and assigns its bid <br />on the property located at 851 Eagles Nest Drive for the amount of $2,189.52 to KKG, LLC. <br />2. Upon approval by Lee County Board of Commissioners, County shall publish notice after adoption <br />of resolutions, and the assignment shall be consummated 10 days after such publication. <br />3. After the 10 day period described above, KKG, LLC shall assume all duties and obligations of the <br />County as the high bidder. <br />4. Mary Yow, Tax Administrator, shall have the authority to execute an Assignment of Bid agreement <br />on behalf of the County. <br />h� <br />Dated this the day of November, 2015. <br />AEST: <br />l M.
