LEE COUNTY <br />Committed Today for a Better Tomorrow <br />RESOLUTION AUTHORIZING THE SALE OF PROPERTY LOCATED AT 1213 <br />CREST STREET IN SANFORD, NORTH CAROLINA <br />WHEREAS, the County of Lee and City of Sanford own certain property located at 1213 <br />Crest Street in the City of Sanford, in Lee County, North Carolina, as shown on a deed recorded <br />in Deed Book 1343, Page 512, in the office of the Register of Deeds for Lee County, to which <br />the record thereof reference is hereby made for more complete description; and, <br />WHEREAS, North Carolina General Statutes §§ 153A-176 and 160A-269 permit the <br />county to sell property by upset bid, after receipt of an offer to purchase the property; and, <br />WHEREAS, to facilitate the sale of jointly owned property, the City of Sanford conveyed <br />such property to the County of Lee, as shown on a deed recorded in Deed Book 1384 Page 851 <br />in the office of the Register of Deeds for Lee County; and, <br />WHEREAS, the County of Lee proposes to dispose of the above described property on <br />behalf of both the City and County as it is surplus to our needs; and, <br />WHEREAS, the County received an offer submitted by Linda Ware ("Offeror"), to <br />purchase the property described above in the amount of $9,177.86 plus any advertising costs, a <br />copy of which is attached hereto; and, <br />WHEREAS, Offeror paid to the County Clerk the required 5 percent (5%) deposit on her <br />offer plus advertising costs; and, <br />WHEREAS, at its regular meeting on April 20, 2015, the Lee County Board of <br />Commissioners accepted the offer of $9,177.86 and such offer was advertised in The Sanford <br />Herald on April 24, 2015; and, <br />WHEREAS, no further upset bids were received during the 10 -day upset bid period, and <br />the original offer from Linda Ware is the final and highest bid received. <br />NOW, THEREFORE, BE IT RESOLVED by the Lee County Board of Commissioners <br />as follows: <br />1. The Lee County Board of Commissioners hereby accepts the offer of $9,177.86 from <br />Linda Ware. <br />2. The terms of the final sale are as follows: Buyer must pay with cash, cashier's check <br />or certified check at the time of closing. <br />
