d0)1- 33- <br />LEE COUNTY <br />Committed Today for a Better Tomorrow <br />RESOLUTION APPROVING SECOND UPSET BID FOR THE SALE <br />OF PROPERTY LOCATED AT 309 W. MAIN STREET IN THE CITY OF SANFORD <br />WHEREAS, the County of Lee owns certain property located at 309 W. Main Street, Sanford, <br />North Carolina, as shown on a deed recorded in Deed Book 113, Page 552 in the office of the Register <br />of Deeds for Lee County, to which the record thereof, reference is hereby made for more complete <br />description; and, <br />WHEREAS, North Carolina General Statutes §§ 153A -176 and 160A -269 permit the county to <br />sell property by upset bid, after receipt of an offer to purchase the property; and, <br />WHEREAS, the County received an original offer submitted by Mary Dangerfield, on behalf of <br />MacAdell & Associates, Inc. and WXKL 1290 AM Radio, to purchase the property described above in <br />the amount of $65,000; and, <br />WHEREAS, Ms. Dangerfield paid to the County Clerk the required five percent (5 %) deposit on <br />its offer plus advertising costs; and, <br />4W WHEREAS, the Lee County Board of Commissioners accepted Ms. Dangerfield's offer of <br />$65,000 at the Board's regular meeting on October 7, 2013, and such offer was advertised in the <br />Sanford Herald on October 10, 2013; and, <br />WHEREAS, Jonesboro Heights Baptist Church submitted a first upset bid in the amount of <br />$68,300 and paid to the County Clerk the required five percent (5 %) deposit on its offer plus advertising <br />costs; and, <br />WHEREAS, the Lee County Board of Commissioners accepted this first upset bid offer from <br />Jonesboro Heights Baptist Church at its regular meeting on October 21, 2013, and such first upset bid <br />offer was published in the Sanford Herald on October 25, 2013; and <br />WHEREAS, Ms. Mary Dangerfield, on behalf of MacAdell & Associates, Inc. and WXKL 1290 <br />AM Radio, has submitted a second upset bid offer in the amount of $71,675; and, <br />WHEREAS, Ms. Dangerfield has paid to the County Clerk the required five percent (5 %) deposit <br />on its offer plus advertising costs; and, <br />WHEREAS, the Lee County Board of Commissioners accepts this second upset bid offer of <br />$71,675 or any higher, upsetting offer, subject to the upset bid procedure. <br />NOW, THEREFORE, BE IT RESOLVED by the Lee County Board of Commissioners as follows: <br />The Lee County Board of Commissioners authorizes the sale of property described <br />above through the upset bid procedure of North Carolina General Statute § 160A- <br />269. <br />
