0 aooK zo ?,U 749 <br />• Section 4.10.4.4 - 1st sentence - Change "shall" to "should" to provide encourage more flexibility. <br />• Section 4.14.4.1 - 1st sentence - Rewrite so that the Community Development Director or his or <br />her designee is the Watershed Administrator. <br />• Section 5.2 Summary (title) - Delete the first two sentences in their entirety. <br />• Section 5.2.2.2 (a) - Rewrite this entire section to read as follows, "Witltii one thousand (1,000) feet <br />of a Residential Zoning District. The distance between a proposed use and a Residential Zoning <br />District shall be measured from the nearest property line of the site containing the adult use or <br />proposed adult use to the nearest boundary line of a Residential Zoning District, measured along a <br />straight line extended between the two points." <br />• Section 5.2.2.2 (b) - Rewrite this entire section to read as follows, "Within two thousand (2,000) feet <br />of any church or other place of worship, elementary or secondary school, day care facility, Dwelling <br />Unit, establishment with an on-premise North Carolina ABC license, or public park that exists or has <br />been permitted at the time the application for approval of the Sexually Oriented Business is filed. <br />The distance between the proposed adult use and a church, school, park, day care or dwelling shall <br />be measured from the nearest property line of the site containing the proposed adult use to the <br />nearest property line of the church, school, park, day care or dwelling, along a strught line extended <br />between the two points." <br />• Section 5.2.2.2 (c) - Rewrite this entire section to read as follows, "\Vlthin two thousand (2,000) feet <br />of any other adult establishment that exists or has been pennitted at the time the application for <br />approval of the Sexually Oriented Business is filed. The distance between the proposed adult use <br />and another existing adult establishment shall be measured from the nearest property line of the site <br />containing the proposed adult use along a strught line extended to nearest property lute of the site <br />containing the existing adult establishment." <br />• Section 5.3.2.2 - At the end of this section, add the following new sentence, "All animal wastes shall <br />be removed daily." <br />• Section 5.4.2.1 - Rewrite entire subsection to read, "The Apphc:utt shall provide to the <br />Administrator a floor plan designating the use and floor area of each room within each building or <br />structure for which rooms will be rented." <br />• Section 5.13.6 - Delete entire section. <br />• Section 5.26 - Re-title this section as "Entertainment Establishments" <br />• Section 5.26.1 - Rewrite this section to read, "This section applies to any premises entertainment <br />establishments, such as lounges, discos, nightclubs, pool halls and private clubs and as similarly <br />classified in Table 4.6-1 of this Ordinance." <br />• Section 5.26.2.1 - Rewrite this section to read, "Regardless of zoning district, entertainment <br />establishments, such as lounges, discos, nightclubs, pool halls and private clubs, shall not be <br />pennitted within the boundaries of the special tax district for the downtown area of the City of <br />Samford." <br />• Section 5.26.2.3 - Add this new section with the following language, "No outdoor loudspeaker or <br />public address systems is permitted." <br />• Section 5.29.2.5 - Rewrite this section to read, "Roadways, proposed points of ingress and egress, <br />and proposed pattern of internal cuculation shall be constructed of asphalt paving and of adequate <br />width to accommodate anticipated traffic and in any case shall meet the following minimum <br />requirements: <br />One-way, no parking - twelve (12) feet; <br />Two-way, no parking - twent}xfour (24) feet." <br />• Section 6.1.1.1 - Rewrite this section to read, "To provide for the coordination of transportation <br />networks and utilities within proposed subdivisions with existing or planned streets and highways <br />and with other public facilities <br />• Section 6.1.1.4 - Rewrite this section to read, "To provide for the distribution of population and <br />traffic in a manner that will avoid congestion and overcrowding and will create conditions that <br />substantiallypromote public health, safety, and the general welfare." <br />• Section 6.3.3.4 (a) - Replace reference to "Planning Commission" with "Local Planting Board". <br />• Section 6.3.3.4 (b) - Replace reference to "Planning Commission' with "Local Planning Board". <br />
