JMk Ash <br />BOOK 40 PAGE 746 <br />AN ORDINANCE AMENDING THE LEE COUNTY <br />UNIFIED DEVELOPMENT ORDINANCE <br />BE IT ORDAINED by the County Commissioners of the County of Lee, North Carolina that the <br />Unified Development Ordinance be, and it hereby is, amended as follows: <br />Section 1. Amend the Unified Development Ordnance to include the following amendments as listed by <br />Section, Article, or Table reference: <br />• Section 1.1.2 - Replace 1- sentence with the following, "In accordance with NCGS 160A-383 and <br />153A-341, the County of Lee (refers collectively to Lee County, City of Sanford, and Town of <br />Broadway) hereby enact this Ordinance to promote the public health, safety and general welfare of <br />its citizens. To that end, these regulations are intended to respond uniformly and consistently to <br />development proposals." <br />• Section 1.1.9 -Add "The Governing Bodies of to the beginning of the 11t sentence. <br />• Section 1.3 - 1st sentence, 2nd paragraph - Rewrite the following phrase "Sanford/Lee County <br />Land Use Plan" as "Sanford/Lee County 2020 Land Use Plan" <br />• Section 1.6.5.1 - Delete 2nd sentence of subsection (b) and rewrite as subsection (c) as follows, "The <br />provisions of this section shall apply only to violations or unmet conditions that occur on the same <br />property for which the permit or other approval is sought." <br />• Section 1.6.6.1 - Rewrite this entire section as follows, "Any violation occurring once within a 12- <br />month period shall be considered a finst offense. An appeal of the Department of Community <br />Development's decision shall be allowed as prescribed under § 1.6.2. A notice shall be sent to the <br />violator indicating that the violation exists and that the violation shall be remedied within 10 days <br />without penalty. The notice shall also indicate that upon the expiration of the 10-day warning <br />period, the violator shall be subject to a civil penalty of $100.00 for each day that the violation <br />remains on the property. Should a violation continue to exist by the thirtieth (30th) day of the <br />original notification, the County of Lee shall seek to recover the penalty together with all costs by <br />filing a civil action in the District Court in the nature of a suit to collect a debt. The collection of a <br />penalty pursuant hereto shall not foreclose funkier proceedings for penalties coming due subsequent <br />to the date of the filing of a prior proceeding. -Ilse provisions of this section may also be enforced <br />through any other appropriate remedies as prescribed in § 1.6.5 of this Section." <br />• Section 1.6.6.2 - Rewrite this entire section as follows, "Any violation that incurred assessed fines <br />reoccurring on the same property by the same violator more than once within a 12-month period <br />shall be considered a repeat offense provided the reoccurrence is a violation of the same Article of <br />this Ordinance. A notice shall be sent to the violator indicating that the violation exists and that the <br />violation shall be remedied within 2 days without penalty. The notice shall also indicate that upon <br />the expiration of the 2-day warning period, A notice of violation shall be issued by the Department <br />of Community Development and shall have an immediate civil penalty of $100.00. For each day the <br />repeat violation remains, the violator shall be subject to a civil penalty of $100.00. Should a violation <br />continue to exist by the thinieth (30th) day of the original notification, the County of Lee shall seek <br />to recover the penalty together with all costs by filing a civil action in the General Court of Justice in <br />the nature of a suit to collect a debt. The collection of a penalty pursuant hereto shall not foreclose <br />funkier proceedings for penalties coming due subsequent to the date of the filing of a prior <br />proceeding. The provisions of this section may also be enforced through any other appropriate <br />remedies as prescribed in § 1.6.5, above." <br />• Article 2 Summary - Amend the 3.1 sentence to unchrde "local planning Boards", add "local" to <br />Boards of Adjustment and acid "Joint" to Planning Commission. <br />• Section 2.1.1 - In the h- sentence, change "Department of Community Development for the County <br />of Lee" to "Sanford/Lee County Community Development". <br />
