acoi '29 FICF 598 <br />or assists in the prosecution of a criminal proceeding under this article shall be liable for damages <br />hereunder unless he acted with malice and without reasonable grounds for believing that the <br />person accused was guilty of an unlawful act or omission. <br />Sec. 470. Housing Appeals Board. <br />(a) There is hereby created a Housing Appeals Board to which appeals may be taken from decisions <br />or orders of the Inspector as provided in Section 4-84. The Board shall consist of five (5) <br />members to serve for three-year staggered terms. The Board shall have power to elect its own <br />officers; to fix the times and places of its meetings; to adopt necessary rules of procedure; and any <br />other rules and regulations which may be necessary for the proper discharge of its duties. The <br />Board shall perform the duties prescribed by this division and shall keep an accurate record of all <br />its proceedings. <br />(b) The Board of County Commissioners shall appoint the five (5) regular members of the Housing <br />Appeals Board for the terms specified above. The Board of County Commissioners shall also <br />appoint five (5) alternate members at large to serve on the Housing Appeals Board in the absence <br />of any regular member. Alternate members shall be appointed to serve three (3) year staggered <br />terms. Each alternate member, while attending any regular or special meeting of the Housing <br />Appeals Board and serving in the absence of any regular member, as provided in the rules of <br />procedure of said Board, shall have and exercise all the powers and duties of any regular member <br />absent from the meeting. <br />DIVISION2. MINIMUM STANDARDS AND REQUIREMENTS <br />See. 4-71. Generally <br />Dwellings and dwelling units used as a human habitation, or held out for use as a human habitation. <br />shall comply with all of the minimum standards offitness for human habitation. All owners and occupants <br />shall comply with the requirements of this article so as to maintain these standards. No person shall occupy <br />as owner-occupant, or let to another for occupanc} or use as a human habitation, any dwelling or dwelling <br />unit which violates this Article. Outbuildings and appurtenances are included in these standards. Stnuctures <br />not meeting these standards shall be demolished and removed from the premises or rehabilitated. <br />Sec. 4-72. Mininunn Space and Use Standards. <br />The following shall constitute the minimum standards for residential buildingand shall be pertinent in <br />determining fitness for human habitation: <br />(a) There shall be at least one habitable room v, fill at least 150 square feet of floor space. Other <br />habitable rooms shall have an area not less than 70 square feet; except that kitchens may have 50 <br />square feet. <br />(b) Those habitable rooms which must be included to meet the Rrregoing minimum space standards <br />shall be at least seven (7) feet side in any pan with an least one-half (1/2) of the floor area <br />having a ceiling height of at least seven (7) feet.
