0 0 <br />~v F cF 575 <br />Page 5 <br />(1) Defects in the heating, air conditioning equipment, and/or water and/or steam apparatuses; <br />(2) The leaking and/or overflowing of water and/or steam apparatuses, sewer pipes, and/or <br />heating and/or plumbing fixtures; <br />(3) The bursting of water, sprinkler, and/or steam apparatuses, <br />(4) The handling of electric wires and/or fixtures; <br />(5) The disrepair of any fixture and/or equipment in or on the Premises or the Building, <br />(6) Any act or negligence of any occupant of the Building, or of any other person whomsoever. <br />10. INSURANCE: <br />a. Landlord Insurance: During the Term and any renewals or extensions of it, Landlord shall <br />maintain, insurance on the Building on a replacement cost basis. Any additional insurance <br />coverage is solely within Landlord's discretion. <br />b. Tenant's Uect On Landlord Insurance: Tenant shall not conduct or permit to be conducted any <br />activity, place or permit to be placed any equipment or.entity in, on, or about the Premises, and/or <br />take or allow to be taken any action that will, in any way, violate any of Landlord's insurance <br />policies, make unavailable to Landlord any desired insurance coverage, and/or increase the rate or <br />premium of such policy. In the event that Tenant violates any part of this Section I O.b, Landlord <br />may, in addition to any other remedies allowed under this Lease, collect from Tenant the amount <br />of any increase in insurance rates or premiums so caused by Tenant. <br />c. Tenant Insurance: During the Term and any and all renewals or extensions of it, Tenant shall <br />maintain the following insurance coverage with an insurer licensed to do business in North <br />Carolina that is reasonably acceptable to Landlord: <br />(1) Comprehensive general liability insurance in an amount not less than $1,000,000; <br />(2) Fire and extended coverage, vandalism and malicious mischief, and water leakage (where <br />applicable) to insure all of Tenant's personal property, fixtures, and furnishings; and <br />(3) Worker's compensation as required by the laws of the State of North Carolina. <br />d. Tenant Insurance SubrQ galion: Tenant hereby releases and waives unto Landlord, its successors <br />and assigns, all rights to claim damages for any injury, loss, cost or damage to persons or any <br />other casualty, as long as the amount of that injury, loss, cost damage or other casualty has been <br />paid to Tenant under the terms of any applicable insurance policy. <br />e. Proof Of Tenant Insurance: Upon request by Landlord, Tenant shall provide to Landlord <br />certificates of insurance evidencing all insurance coverages required under this Lease. Such <br />certificates shall: <br />(1) Name Landlord, its directors, agents, property manager, and employees as additional <br />insureds; <br />(2) Expressly provide that Landlord's interests shall not be affected by any breach by Tenant of <br />any policy provision for which such certificates evidence coverage, and <br />(3) Expressly provide that Tenant shall give to Landlord thirty days prior written notice of any <br />material alteration to or cancellation of the coverages evidenced by such certificates. <br />11. ASSIGNMENT AND SUBLETTING: Tenant shall not assign or sublet any part of the Premises <br />or any right or privilege under this Lease without the prior written consent of Landlord. Landlord may <br />assign this Lease in its discretion. <br />12. DEFAULT: <br />a. Events of De ault Without excluding any other provision of this Lease, Tenant shall be deemed <br />to be in default should one or anv combination of the following occur: <br />
