G ~u r' GE 55$ <br />STATE OF NORTH CAROLINA <br />COUNTY OF LEE <br />IN THE MATTER OF THE ) <br />APPLICATION OF NEW CINGULAR ) <br />WIRELESS PCS, LLC ) <br />FOR A CONDITIONAL USE PERMIT ) <br />APPLICATION NO. 2005-0702 ) <br />BEFORE THE <br />LEE COUNTY <br />BOARD OF COMNUSSIONERS <br />ORDER <br />THIS MATTER coming on to be heard before the Lee County Board of Commissioners on <br />August 15, 2005 on the application of New Cingtdar Wireless PCS, LLC for an amended <br />Conditional Use Permit with respect to a 7.45 acre tract of land identified as Parcel Identification <br />Number 9528-90-4220 located at 7009 Old Jefferson Davis Highway (formerly 5103 Jefferson Davis <br />Highway) in which the applicant seeks an amendment that will retain the existing use of six <br />residential apartments and add a 250' monopole wireless telecommunications tower and equipment <br />facility. The existing use was approved in application 1994-0201 on March 21, 1994. The tower will <br />be contained within a 100' X 100' leasehold area as depicted on the site plan filed with this <br />application. A joint public hearing was held upon this application by the Board of Commissioners <br />and the Planning Board on July 25, 2005, at which time Karen K. Prather, Attorney At Law of the <br />firm Blanchard, Jenkins, Miller, Lewis & Styers, P.A., appeared on behalf of New Cingular Wireless <br />PCS, LLC. No one appeared in opposition to the application. The Lee County Planning Board has <br />recommended approval of the amendment to include a 250' monopole wireless telecommunications <br />tower and equipment facility. <br />Based upon the evidence presented, the Board of Commissioners makes the following <br />findings: <br />(1) that the use will not materially endanger the public health or safety if located where <br />proposed and developed according to the application and plan as submitted and <br />approved; <br />(2 that the use meets all required conditions and specifications; <br />(3) that the use will not substantially injure the value of adjoining or abutting <br />property; and <br />(4) that the location and character of the use, if developed according to the application and <br />plan submitted, will be in harmony with the area in which it is to be located and in <br />
