t"", ^7 iGE t` 1 0 wu,A , F~ AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF LEE COUNTY, NORTH CAROLINA WHEREAS, Lee County has a Board of Adjustment appointed in accordance with the provisions of North Carolina General Statutes Section 153A -345 (N.C.G.S. 153A-345) and WHEREAS, the present Board of Adjustment has been called upon to hear three (3) appeals in the past five (5) years; and WHEREAS, the aforementioned statute provides "A County may designate a planning agency to perform any or all of the duties of a Board of Adjustment in addition to its other duties.". and WHEREAS, the Town of Broadway have designated their Planning Board to act as a Board of Adjustment in their j urisdictions; and WHEREAS, the Board of Commissioners of Lee County is of the opinion that the skills and talents of the members of the present Board of Adjustment could be better utilized on other County boards and agencies and that the designation of the Lee County Planting Board to perform all of the duties of the Board of Adjustment in addition to its other duties would not be unduly burdensome; now, therefore, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF LEE COUNTY, NORTH CAROLINA THAT THE ZONING ORDINANCE OF LEE COUNTY, NORTH CAROLINA BE, AND IT HEREBY IS, AMENDED AS FOLLOWS: Section 1. That the appointments and terms of office of the present members of the Lee County Board of Adjustment are hereby terminated with the thanks and appreciation of the people of Lee County for their past service and willingness to serve in this capacity. Section 2. Section 1, 2, 3, and 4 of Article XII of the Zoning Ordinance are deleted. Section 3. A new Section I is enacted which reads as follows: Section 1. Board of Adjustment Created. "The Lee County Planning Board is hereby designated as the Planning agency to perform all of the duties of a Board of Adjustment."
