Ank UJUA ~v PH 500 <br />County Manager David Smitherman briefly discussed the monthly financial report which <br />has not been audited to date. No action was taken. <br />• County Manager David Smitherman updated the Board on a recent meeting between <br />County representatives, City representatives, and Health Department staff concerning the <br />Animal Control issue with the City of Sanford. Mr. Smitherman stated that the meeting went <br />well and all individuals are committed to resolve the issue. The matter will be discussed in more <br />detail at the Board of Commissioners August 15, 2005 meeting. <br />Chairman Hincks moved to go into closed session per N.C. General Statute § 143- <br />318.11(a)(6) to discuss a personnel matter. Upon a vote, the results were as follows: <br />Aye: Adams, Brown, Hincks, Lemmond, Reives, and Stevens <br />Nay: None <br />Absent: Paschal <br />The Chairman ruled the motion had been adopted unanimously and the Board was in <br />closed session. Upon completing business in closed session, Commissioner Lemmond moved <br />to go out of closed session. Upon a vote, the results were as follows: <br />Aye: Adams, Brown, Hincks, Lemmond, Reives, and Stevens <br />Nay: None <br />Absent: Paschal <br />The Chairman ruled the motion had been adopted unanimously. <br />• Chairman Hincks recessed the meeting till 7:00 p.m. <br />At 7:00 p.m., the meeting resumed in Courtroom #4 at the old Lee County Courthouse. <br />All members were present except Commissioners Paschal and Reives. <br />Chairman Hincks called the meeting to order. <br />The first petition was presented by Assistant Community Development Director Marshall <br />Downey. The petition involved a request from the Sanford-Lee County Community Development <br />Office to amend the Lee County Zoning Ordinance to dissolve the membership of the current <br />Board of Adjustment and appoint the Lee County Planning Board to serve as the Board of <br />Adjustment. <br />No one present spoke in favor of or in opposition to the petition. <br />Chairman Hincks closed the above public hearing and opened the second advertised <br />public hearing. <br />Clerk to the Board Gaynell Lee administered the oath of office to Attorney Karen Prather <br />of 1117 Hillsborough Street, Raleigh; and Archie Brooks of 7119 Old Jefferson Davis Highway, <br />Sanford, prior to the presentation. Attorney Prather, representing New Cingular Wireless PCS, <br />LLC told the Board that New Cingular Wireless was requesting a revision to the existing <br />Residential-Mixed Conditional Use District with Conditional Use Permit for six residential <br />apartment units, to retain the existing approved use and add the following use: <br />r~ <br />L <br />7 <br />
