® 1. The occupant household will not be relocated during the rehabilitation work unless it is deemed necessary by Lee County Community Development Office. 8. The Contract consists of the work write-up, the general conditions and specifications and/or drawings for work to be done for the specific property involved which by this reference are incorporated herein and made a pan of this agreement. 9. Termination Provision: In the event of breach of any condition or provision hereof, Lee County Community Development Office shall have the right by prior written notice, to terminate the Contractor's employment hereunder and cancel this Contract and have the work called for hereby otherwise performed without prejudice to any other rights or remedies of Lee County. Lee County shall have benefit of such work as may have been completed up to the time of such termination or cancellation and with respect to any part which shall have been delivered to and accepted by Lee County Community Development Office, there shall be an equitable adjustment of compensation based on Lee County Community Development Office's determination. 10. No person employed on the work covered by this Contract shall be discharged or in any way discriminated against because he has filed any complaint or instituted or caused to be instituted any proceeding or has testified or about to testify in any proceeding under or any relating to the labor standards, applicable hereunder to his employer. 11. The Contractor's Obligations and duties under this Contract shall not be assigned, in whole or in part, without prior approval of Lee County Community Development Office. 41 12. Conflict of Interest: The Contractor covenants that he presently has no interest and shall not acquire any interest, direct or indirect, in the above described Project Area or any parcels therein or any other interest which would conflict in any manner or degree with the performance of his services hereunder. The Contractor further covenants that in the performance of this Contract, no person having such interest shall be employed. The above covenant of no interest also applies to the contractor's immediate family and his or her business partners. 13. For the consideration named herein, the Contractor agrees to furnish all labor, materials, equipment, services, and permits and do all work described in and in accordance with the work write-up and identified above in this Contract. 14. Certificate of Completion and procedure for final payment of the Contract: Upon completion of the work required to be performed by the Contractor in accordance with the Contract and the Property Rehabilitation Standards, and upon certification by the Building Inspector, Lee County Community Development Office shall so indicate by issuing a Certificate of Final Inspection. If Lee County Community Development Office signs the Certificate of Final Inspection, then Lee County shall be authorized to deliver a check to the Contractor for final payment under the terms of the Contract, and the check shall be issued directly to the Contractor. If the owner refuses to sign the acceptance, a process for reviewing the owner's complaints about the Contractor's work shall S begin.
