0 0 <br />-Uox `:u PAGE 505 <br />O <br />Article VIII <br />The Contractor asks that dirt, tires, plastic, wood, glass or paper not to be piled on top of the white goods or <br />scrap metal, for these items cannot be shredded. The Contractor asks that light ballasts, freon tanks, <br />propane tanks, gas tanks, and barrels be stored in a separate area. <br />Article IX <br />The Contractor will be responsible for the removal of freon. The Contractor shall adhere to and comply <br />with all environmental laws, rules and regulations and is certified by the EPA in freon recovery. Also the <br />Contractor shall meet all requirements of the 608 Clean Air Act. The Contractor agrees to and meets all <br />rules and regulations set by OSHA standards. The Contractor shall provide the County a freon manifest <br />upon completion of the job. <br />Article X <br />The parties recognize and agree this agreement constitutes the entire agreement and any amendments <br />hereto shall be made only in writing and executed by both parties. <br />Article XI <br />The Contractor agrees to make contact with a concrete contractor to pour a holding pad for the white goods <br />located at the County. The Contractor shall pay the County 22% of the market value of white goods <br />removed from the designated site. Market value shall be determined by reference to market value of <br />Number 2 Bundles-Carolinas Market as published by the American Metal Market on the second Friday of <br />the month in which metal is removed. (Example: Price paid to the County for March 2005 would be <br />$19.80 per gross ton.) The lowest amount paid to the County will be $12.00 per gross ton. The County <br />shall determine the distribution of payment for white goods hauled. The County may receive total payment <br />• or allocate money towards expanding the concrete pad. <br />Article XII <br />Correspondence relating to this agreement shall be forwarded to the respective parties by U.S. Certified <br />Mail, Return Receipt Requested at the address indicated below: <br />County: Lee County Public Works <br />805 S. Fifth Street <br />Sanford, NC 27330 <br />ATTN: Kenneth C. Cole, Assistant County Manager <br />Contractor: State Line Scrap Metal, Inc. <br />5401 S. York Hwy <br />Gastonia, NC 28052 <br />ATTN: Michael P. Aho, Vice President <br />Article XIII <br />The Contractor agrees to indemnify and hold the County harmless from any and all actions, causes of <br />actions, claims, liabilities, damages and the like including a reasonable attorney fees, that may result from <br />the Contractor's actions in handling the white goods and scrap metal including but not limited to the failure <br />of Contractor to comply with environmental laws, regulations. <br />Article XIV <br />The Contractor, its agents, employees, contractors and sub-contractors shall not discriminate on the basis of <br />race, color, creed, national origin, ancestry, age, sex, religion, or disability in any policy or practice. <br />• Contractor shall abide by all applicable U.S. and North Carolina Labor Laws, including but not limited to, <br />Occupational Safety and Health regulations, Fair Labor Standards Act, and the Americans with Disabilities <br />Act and regulations pursuant therein. <br />
