uo0;( u PAGE S~ <br />0 White Goods Diversion Separation Agreement <br />Whereas, Lee County, herein after known as "the County", wishes to enter into a service agreement with <br />State Line Scrap Metal, Inc., herein after known as "Contractor". <br />Whereas, the County desires to separate and divert portions of recyclable materials from its designated sites <br />as well as stimulate a growing recycling market: <br />Whereas, the County desires to separate and release white goods and scrap metal at the various sites to the <br />Contractor for the purpose of recycling: <br />Whereas, the Contractor will collect these recyclable materials at an area of the designated sites to be <br />determined by the parties of this agreement: <br />Now, therefore, for the consideration herein stated and subject to the conditions provided herein, the <br />County and the Contractor do hereby enter this agreement for separation and collection of white goods and <br />scrap metal, as follows: <br />Article I <br />The County shall separate and store various white goods and scrap metal in an area agreeable to both the <br />County and the Contractor at the designated landfill sites. <br />Article II <br />e The County shall provide the necessary personnel, equipment and facilities for the collection, separation <br />and storage of white goods and scrap metal. The white goods and scrap metal to be collected are identified <br />as stoves, refrigerators, freezers, pair conditioners, water heaters, bathtubs, culverts, wire and fencing, <br />exercise equipment, bicycles, lawn maintenance equipment, grills, structural steel and tin. White goods and <br />scrap metal will be stored in one area and contaminates listed in Article VIII will be stored and stacked to <br />the side. The County will be responsible for the removal of said items. <br />Article III <br />The Contractor shall collect and remove the white goods and scrap metal when the County advises that it <br />has collected approximately two hundred (200) tons of it. <br />Article IV <br />The Contractor shall provide all personnel, hauling equipment and other resources for the loading and <br />transporting of the recyclable materials. The Contractor shall also provide the County proof of liability <br />insurance and workers compensation coverage on all employees of at least $1,000,000 and maintain in full <br />force and effect during the term of the contract and renewals. <br />Article V <br />The Comity agrees that title to the white goods and scrap metal shall pass to the Contractor at the time <br />which it is loaded into the Contractors trailers. The Comity shall assume all responsibility for the white <br />goods and scrap metal until loaded by the Contractor. <br />Article VI <br />The Contractor shall assume liability for all applicable local state and federal laws, including but not <br />limited to transportation of white goods and scrap metal and any applicable laws governing die processing <br />of scrap metal. <br />• Article VII <br />Except, as herein after set forth, the term of this agreement is for 5 years from the date set here forth. This <br />contract will automatically renew unless otherwise notified with 30 days prior to the end of the contract. <br />
