3. Each supervisor will provide safety training in use of equipment and <br />hazardous chemicals. This training will be ongoing, and documented by <br />the supervisor. It will be made available upon request to facility/region <br />officials, and/or safety inspectors. Training documentation will be signed <br />by the supervisor and inmate. <br />4. Work schedules will be provided by Lee Co. Oper. Serv. <br />5. Supervisors will designate break areas and ensure that inmates are <br />supervised during all breaks. <br />6. Supervisors are to receive annual training. <br />7. Supervisors are to receive briefing in Undue Familiarity as part of training. <br />IV. Safety Equipment <br />A. Division of Prisons will provide steel-toed shoes. No inmates will be allowed to - <br />work without steel-toed shoes. <br />B. Lee Co. Oper. Serv. will furnish all other OSHA required safety <br />equipment and OSHA postings of safety requirements. <br />C. Supervisors will ensure that all inmates utilize all required safety equipment in <br />the performance of their duties. <br />V. Waiver and Billing Information <br />It is agreed that the North Carolina Department of Correction will waive administrative <br />costs, transportation and custody supervision costs. <br />VI. Medical <br />Injury or death arising out of and in the course of assignment to work under the <br />supervision of the governmental agency for which the Department of Correction is <br />required to pay compensation to such inmate, his dependents or next-of-kin, under the <br />provisions of G.S. 97-13, the governmental agency shall reimburse the Department of <br />Correction. <br />VII. Inmate Conduct <br />Lee Co. Oper. Serv, reserves the right to refuse or return an inmate should <br />safety, security or order be questionable and agrees to follow North Carolina Department <br />of Correction's rules and regulations as stipulated in the Supervisory Training session. <br />Division of Prisons will be the sole party responsible for issuing disciplinary action <br />against any inmate employed by Lee Co. Oper. Serv. . Any misconduct will be <br />reported immediately to Division of Prisons facility superintendent. Either party with a <br />30-day notice may terminate the contract at any time. <br />Page 3 of 3 <br />
