5020 PAGE 316 . <br />PAGE2 <br />(3) To operate and maintain said equipment at no cost to the State, <br />(4) To provide a permanent license plate which will be used on the said <br />equipment, <br />(5) To obtain prior to receipt of said equipment, and to continue in effect for the <br />duration of the LEASE, liability insurance in the amount of at least $100,000 per <br />person bodily injury, $300,000 bodily injury in one (1) accident and $50,000 <br />property damage, and to provide the DEPARTMENT with the name of the <br />insurance company, policy number, and effective date of coverage, <br />(6) To be responsible for worker's compensation for any individual injury while <br />using or operating said equipment, <br />(7) To make equipment available for annual inspection by the DEPARTMENT <br />representative upon request, <br />(8) THAT THE EQUIPMENT WILL NOT BE SOLD, JUNKED, OR TRADED but <br />must be returned to a location designated by the DEPARTMENT when no longer <br />needed or usable, <br />(9) To comply with Title VI of the Civil Rights Act of 1964 (P-L. 88-352) and in <br />accordance with Title VI of that Act, no person in the United States shall, on the <br />ground of race, color, or natural origin, be excluded from participation in, be <br />denied the benefits of, or be otherwise subjected to discrimination under any <br />program or activity for which the applicant receives Federal financial assistance <br />and will immediately take any measures necessary to effectuate this agreement. <br />To comply with Title VI of the Civil Rights Act of 1964 (42 USC 2000d) <br />prohibiting discrirmnation where discriminatory practices will result in unequal <br />treatment of persons who are or should be benefiting from the activity. <br />It is Mutually Agreed That <br />(1) The equipment will be marked in a manner that will indicate cooperation between <br />the COOPERATOR and the DEPARTMENT. The COOPERATOR will place a <br />decal, furnished by the DEPARTMENT (Division of Forest Resources), on <br />each door acknowledging that the vehicle is on loan as part of the Cooperative <br />Program, <br />(2) The COOPERATOR will store the vehicle in a building to prevent damage from <br />theft and/or vandalism. The COOPERATOR will store the vehicle in a heated <br />building during the winter to prevent damage to the equipment from freezing, <br />(3) The equipment is limited to lire use only or other emergency use, as approved <br />by the Department, <br />(4) The DEPARTMENT will not be responsible for furnishing spare parts for <br />the vehicle, <br />(5) The Agreement shall be effective from the date of execution by the <br />Department of Environment & Natural Resources and will <br />continue in force from year to year, unless terminated by either <br />party by thirty (30) days written notice to the other, provided, however, that <br />all of the provisions hereinafter are complied with. <br />
