NORTH CAROLINA, a body politic <br />and corporate existing under the laws of the State of North Carolina (the `County"), and THE <br />LEE COUNTY BOARD OF EDUCATION, a bode corporate existinc, under the laws of the State <br />of North Carolina (the Board of Education"); <br />WITNESSETH: <br />WHEREAS, the County is a body politic and corporate existing under the laws of the <br />State of North Carolina vested with the powers and authority conferred upon counties by the laws <br />of the State of North Carolina. acting through its Board of Commissioners; <br />WHEREAS. the Board of Education is the governing board of the Lee County local <br />school administrative unit of [lie public school system of the State of North Carolina, vested with <br />the powers and authority conferred upon boards of education by the laws of the State of North <br />Carolina, including general control and supervision of all matters pertaining to the public schools <br />in the Count),; <br />WHEREAS. the County owns a certain parcel of real property (the "Site") more fully <br />described in Exhibit A to the Original Lease hereinafter mentioned: <br />WHEREAS. the County, as lessor, and the Board of Education, as lessee, have heretofore <br />entered into a Lease Agreement, dated as of January 1, 2004 (the "Original Lease"), pursuant to <br />which the County has leased the Site and all buildin-s.. improvements and fixtures located and to <br />be located thereon to the Board of Education; <br />
