NORTH CAROLINA, a body politic and corporate existing under the laws of the State of North Carolina (the `County"), and THE LEE COUNTY BOARD OF EDUCATION, a bode corporate existinc, under the laws of the State of North Carolina (the Board of Education"); WITNESSETH: WHEREAS, the County is a body politic and corporate existing under the laws of the State of North Carolina vested with the powers and authority conferred upon counties by the laws of the State of North Carolina. acting through its Board of Commissioners; WHEREAS. the Board of Education is the governing board of the Lee County local school administrative unit of [lie public school system of the State of North Carolina, vested with the powers and authority conferred upon boards of education by the laws of the State of North Carolina, including general control and supervision of all matters pertaining to the public schools in the Count),; WHEREAS. the County owns a certain parcel of real property (the "Site") more fully described in Exhibit A to the Original Lease hereinafter mentioned: WHEREAS. the County, as lessor, and the Board of Education, as lessee, have heretofore entered into a Lease Agreement, dated as of January 1, 2004 (the "Original Lease"), pursuant to which the County has leased the Site and all buildin-s.. improvements and fixtures located and to be located thereon to the Board of Education;
