NOW THEREFORE BE IT RESOLVED, by the Lee County Board of Commissioners as follows: <br />1. The Board does hereby make the following findings based upon (i) the report provided <br />to the Board pursuant to North Carolina General Statute §153A -302; (ii) comments made at the June <br />24, 2013 public hearing; and (iii) additional evidence and information received by the Board: <br />a. A demonstrable need for fire protection and emergency response services exists <br />within the proposed Deep River Fire Protection and Emergency Response Service <br />District; <br />b. It is impossible or impracticable to provide fire protection and emergency response <br />services on a county -wide basis; <br />c. It is economically feasible to provide fire protection and emergency response <br />services in the proposed Deep River Fire Protection and Emergency Response <br />Service District without unreasonable or burdensome annual tax levies; and, <br />d. There is a demonstrable demand for fire protection and emergency response <br />services by the property owners and persons residing in the proposed Deep River <br />Fire Protection and Emergency Response Service District. <br />2. Based upon the foregoing findings and in accordance with the Act, the Board does <br />hereby establish and define a tax - supported service district for the provisions of fire protection and <br />emergency response services, which district is named the Deep River Fire Protection and Emergency <br />Response Service District and does hereby define the District as including the territory shown on the <br />attached map marked as Exhibit A which is incorporated by reference as if fully set -out herein. <br />3. The Board decrees that the establishment of the Deep River Fire Protection and <br />Emergency Response Service District shall have no effect on the existence of the Deep River RFP <br />District as a legal entity, but that the tax rate for the Deep River RFP District shall be set at "0" (zero) <br />for as long as the Deep River Fire Protection and Emergency Response Service District shall exist. <br />Adopted this th day of June, 2013. <br />Charles T.
