Supplemental Development Regulations, Section 5.19 Landfills, LCiD and <br />CDLF be deleted in its entirety and rewritten as follows: <br />5.19.1 APPLICABILITY <br />5.10.1.1 The standards of this § 5.19 shall apply to any Land Clearing and Inert Debris Landfill <br />("LCID Landfill') that is two (2) acres or less in size and conform to the criteria for LCID landfills that do <br />not require a State permit as set forth inI5A NCAC 13B. 0563 of the North Carolina Administrative Code. <br />5.19.1.2 An LCID landfill includes any facilityfor the land disposal of land clearing waste, concrete, <br />brick, concrete block, uncontaminated soil, gravel and rock, untreated and unpainted wood, and yard <br />trash. For purposes of this definition, "land clearing waste" means solid waste which is generated solely <br />from land clearing activities such as stumps, trees, limbs, brush, grass, and other naturally occurring <br />vegetative material. (Source: 15A NCAC § 13B.0101; see also NCGS § 130A-290). <br />5.19.2 COPY OF RECORDED NOTIFICATION REQUIRED. <br />Small LCID landfills, as defined in this § 5.19, must submit a copy of the notarized and recorded <br />notification as required by the State as prescribed by NCAC 138.0563. The copy of the recorded <br />notification shall include the Register of Deeds seal and the date, book and page number ofrecording. A <br />copy of the recorded notification must be submitted to the Administrator in order to obtain zoning <br />approval. <br />Section 7. Article 5. Supplemental Development Regulations, Section 5.20 Landfill, Sanitary be <br />deleted in its entirety and rewritten as follows: <br />5.20.1 APPLICABILITY <br />5.20.1.1 This section applies to any Sanitary Landfill, which includes airy facility for the disposal of <br />solid waste on land in a sanitary manner in accordance with the rules concerning sanitary landfills <br />adopted under this Article. (Source: NCGS § 130A-290). !Clore specifically, sanitary landfills includes: <br />• Construction and Demolition Landfills (CDLF), which include disposal facilities which store solid <br />waste resulting solely from construction, remodeling, repair, or demolition operations on pavement, <br />buildings, or other structures, but does not include inert debris, land-clearing debris or yard debris. <br />(Source: NCGS § 130A-290). <br />• Land Clearing and Inert Debris Landfills ("LCID Landfill') ofgreater than two (2) acres in size.
