BOOK 0 1'a 408 <br />shall open and read all qualifying bids. Bids with conditions or terms not <br />contained in the original offer will not be accepted or considered. The higher <br />qualifying bid becomes the new offer under consideration. In the case of identical <br />bids, the one submitted earliest will be the one accepted as high bid. <br />8. The Clerk to the Board is directed, should a qualifying bid as hereinbefore <br />described, be received within the time allowed by law, to re-advertise the offer at <br />the increased bid amount as often as is necessary until a final qualifying bid <br />which has not been upset is received. <br />9. The terms of the final sale are that: <br />a. With respect to the jointly owned property both the City Council and the <br />Board of Commissioners must approve the final high offer before the sale <br />is closed, which they will do within thirty days (30) after the final upset <br />period has passed; <br />b. With respect to the solely owned property the Board of Commissioners <br />must approve the final offer before the sale is closed which it will do within <br />thirty days (30) after the final upset period has passed; <br />c. The buyer must pay the purchase price in full at the time of closing- <br />1 O.The City and the County both reserve the right to withdraw the property from sale <br />at anytime before the final high bid is accepted and the right to reject at anytime <br />all of the bids. <br />Adopted this the 5th day of June 2006. <br />Herbert A.
