BOOK 9 PACE 4O't - PI IMINARY CONDEMNATION SOLUTION WHEREAS, the City of Sanford and the County of Lee jointly operate an airport, a public enterprise, through a joint agency known as the Sanford- Lee County Airport Commission; and WHEREAS,the legal title to all the real property necessary to the e. undertaking is and shall be held jointly as tenants in common in equal proportions, and WHEREAS, the Sanford-Lee County Airport Commission has recommenc and the Board of Commissioners for the County of Lee has determined that it is in the best interestfsor the County of Lee, acting with the City of Sanford, to jointly acquire the necessary land and rights in land identified on the map to which reference is hereafter made as "Property Map Exhibit 'A' Sanford-Lee County Airport" by William and Works, Engineers, to enlarge, improve, and extend the Sanford-Lee County Airport. NOW, THEREFORE, under and by virtue of the provisions of General Statutes 153A-159 and upon motion of Commissioner Rhyne , seconded by Commissioner Funderburke and duly adopted, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS FOR LEE COUNTY AS FOLLOWS: 1. That Lee.County elects to use the procedure of Chapter 160A, Article II in exercising the power of eminent domain. 2. The description of the lot, tract or parcel of land in which property rights are intended to be acquired by the County of Lee is set forth in Exhibit A annexed to this resolution and incorporated here in by reference. 3. The nature of the right title or interest intended to be acquired by the County of Lee is the fee simple title to the parcels described in Exhibit A annexed to this resolution and incorporated herein by reference. 4. The purpose for acquiring the aforesaid land is to enlarge, improve, and extend the Sanford-Lee County Airport. 5. The owner(s) of the property to be condemned will be permitted to remove all buildings, structures, permanent improvements and fixtures situated on or affixed to said property. 6. The name and address of the owner(s) of the property to be condemne and all other persons known to have an interest in the property to be condemned are as follows: Joe D. Godfrey, Route 1, Sanford, N. C. Annie Mae P. Godfrey, Route 1, Sanford, N. C. Lee County Ad Valorem Property Taxes 7A. The composition, method of selection and general duties of the Board of Appraisers of the property sought to be condemned shall be as set forth in Section 248, 249, and 250 of Chapter 160A of the General Statutes of North Carolina, to wit- § 160A-248. Board of appraisers. - (a) The property described in the preliminary condemnation resolution shall be appraised by a board of appraisers composed of one person appointed by the sty (who shall be named in the preliminary condemnation resolution), one person appointed by the owner, and one person appointed jointly by the other two appraisers. Each appraiser shall be a freeholder of the city or a county wherein the property being condemned lies who has no right, title, or interest in or to the property being condemned, is not related by blood or marriage to any of the owners, is not an officer, employee, or a ent of the city, and is disinterested in the rights of the parties in every way. Either the city or the owner may reject an appraiser appointed by the other or by the city's and owner's appraiser if the person so appointed is not disinterested. Notice of rejection of an appraiser shall be given within 48 hours of his appointment or else the right to object shall be deemed to have 1K-en
