BOOK 9 PACE 4O't <br />- PI IMINARY CONDEMNATION SOLUTION <br />WHEREAS, the City of Sanford and the County of Lee jointly operate <br />an airport, a public enterprise, through a joint agency known as the Sanford- <br />Lee County Airport Commission; and <br />WHEREAS,the legal title to all the real property necessary to the <br />e. <br />undertaking is and shall be held jointly as tenants in common in equal <br />proportions, and <br />WHEREAS, the Sanford-Lee County Airport Commission has recommenc <br />and the Board of Commissioners for the County of Lee has determined that it is <br />in the best interestfsor the County of Lee, acting with the City of Sanford, to <br />jointly acquire the necessary land and rights in land identified on the map to <br />which reference is hereafter made as "Property Map Exhibit 'A' Sanford-Lee <br />County Airport" by William and Works, Engineers, to enlarge, improve, and <br />extend the Sanford-Lee County Airport. <br />NOW, THEREFORE, under and by virtue of the provisions of General <br />Statutes 153A-159 and upon motion of Commissioner Rhyne , <br />seconded by Commissioner Funderburke and duly adopted, <br />BE IT RESOLVED BY THE <br />BOARD OF COMMISSIONERS FOR LEE COUNTY AS FOLLOWS: <br />1. That Lee.County elects to use the procedure of Chapter 160A, <br />Article II in exercising the power of eminent domain. <br />2. The description of the lot, tract or parcel of land in which property <br />rights are intended to be acquired by the County of Lee is set forth in Exhibit <br />A annexed to this resolution and incorporated here in by reference. <br />3. The nature of the right title or interest intended to be acquired by <br />the County of Lee is the fee simple title to the parcels described in Exhibit <br />A annexed to this resolution and incorporated herein by reference. <br />4. The purpose for acquiring the aforesaid land is to enlarge, improve, <br />and extend the Sanford-Lee County Airport. <br />5. The owner(s) of the property to be condemned will be permitted to <br />remove all buildings, structures, permanent improvements and fixtures <br />situated on or affixed to said property. <br />6. The name and address of the owner(s) of the property to be condemne <br />and all other persons known to have an interest in the property to be condemned <br />are as follows: <br />Joe D. Godfrey, Route 1, Sanford, N. C. <br />Annie Mae P. Godfrey, Route 1, Sanford, N. C. <br />Lee County Ad Valorem Property Taxes <br />7A. The composition, method of selection and general duties of the <br />Board of Appraisers of the property sought to be condemned shall be as set <br />forth in Section 248, 249, and 250 of Chapter 160A of the General Statutes of <br />North Carolina, to wit- <br />§ 160A-248. Board of appraisers. - (a) The property described in the <br />preliminary condemnation resolution shall be appraised by a board of appraisers <br />composed of one person appointed by the sty (who shall be named in the <br />preliminary condemnation resolution), one person appointed by the owner, and <br />one person appointed jointly by the other two appraisers. Each appraiser shall <br />be a freeholder of the city or a county wherein the property being condemned <br />lies who has no right, title, or interest in or to the property being condemned, <br />is not related by blood or marriage to any of the owners, is not an officer, <br />employee, or a ent of the city, and is disinterested in the rights of the parties <br />in every way. Either the city or the owner may reject an appraiser appointed <br />by the other or by the city's and owner's appraiser if the person so appointed <br />is not disinterested. Notice of rejection of an appraiser shall be given within 48 <br />hours of his appointment or else the right to object shall be deemed to have 1K-en <br />
