0 BOOK no PkGE 893 AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF LEE COUNTY, NORTH CAROLINA WHEREAS, a request to amend the Official Zoning Map has been received from Daryl K. Jones (Case #2006-0302) to rezone 15.96+- acres, (a portion of Tax Parcel 9686-18-3934, Lee County Land Records Office) from the current Residential Agricultural (RA) district to a conditional zoning district to be know as the "Lee County Mud Motorsports Complex". WHEREAS, said request has been presented to the Lee County Planning Board; and WHEREAS, the Lee County Board of Commissioners conducted a public hearing on March 20, 2006 to receive citizen input on the requested zoning map amendment; and WHEREAS, the Lee County Board of Commissioners approves the request to amend the Official Zoning Map of Lee County, North Carolina; NOW, THEREFORE, BE IT ORDAINED BY THE LEE COUNTY BOARD OF COMMISSIONERS: The Official Zoning Map is hereby amended to rezone 15.96+- acres, (as shown on the approved site plan, and being a portion of Lee County Tax Parcel 9686-18-3934) from the current Residential Agricultural (RA) district to a conditional zoning district to be known as the "Lee County Mud Motorsports Complex" conditional zoning district. In making this decision, the Board of Commissioners finds that the request appears to be reasonable and in the public interest based on the infortnation/conditions as presented in the conditional zoning application and because the request appears to conform to the recommendations of the Lee County Flood Damage Prevention Ordinance. The Board of Commissioners also finds that because this request is a conditional zoning request that the Lee County Mud Motorsports Complex conditional zoning district shall include the following conditions: General Conditions: • The Lee County Mud Motorsports Complex zoning district shall be limited to the development shown on the site plan as submitted and included in the conditional zoning application (Exhibit A, which includes a detailed site plan, lighting plan and boundary survey). • There shall be no practice for hire on the site of the Lee County Mud Motorsports Complex. Land Uses Permitted: • Land uses within the Lee County Mud Motorsports Complex zoning district shall include a mud motor sports complex and all land uses currently allowed in the Residential Agricultural District, and listed in Table 4.6-1 of the Unified Development Ordinance (Exhibit B).
