0 BOOK no PkGE 893 <br />AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP <br />OF LEE COUNTY, NORTH CAROLINA <br />WHEREAS, a request to amend the Official Zoning Map has been received from Daryl K. <br />Jones (Case #2006-0302) to rezone 15.96+- acres, (a portion of Tax Parcel 9686-18-3934, Lee <br />County Land Records Office) from the current Residential Agricultural (RA) district to a <br />conditional zoning district to be know as the "Lee County Mud Motorsports Complex". <br />WHEREAS, said request has been presented to the Lee County Planning Board; and <br />WHEREAS, the Lee County Board of Commissioners conducted a public hearing on March 20, <br />2006 to receive citizen input on the requested zoning map amendment; and <br />WHEREAS, the Lee County Board of Commissioners approves the request to amend the <br />Official Zoning Map of Lee County, North Carolina; <br />NOW, THEREFORE, BE IT ORDAINED BY THE LEE COUNTY BOARD OF <br />COMMISSIONERS: <br />The Official Zoning Map is hereby amended to rezone 15.96+- acres, (as shown on the approved <br />site plan, and being a portion of Lee County Tax Parcel 9686-18-3934) from the current <br />Residential Agricultural (RA) district to a conditional zoning district to be known as the "Lee <br />County Mud Motorsports Complex" conditional zoning district. In making this decision, the <br />Board of Commissioners finds that the request appears to be reasonable and in the public interest <br />based on the infortnation/conditions as presented in the conditional zoning application and <br />because the request appears to conform to the recommendations of the Lee County Flood <br />Damage Prevention Ordinance. <br />The Board of Commissioners also finds that because this request is a conditional zoning request <br />that the Lee County Mud Motorsports Complex conditional zoning district shall include the <br />following conditions: <br />General Conditions: <br />• The Lee County Mud Motorsports Complex zoning district shall be limited to the <br />development shown on the site plan as submitted and included in the conditional zoning <br />application (Exhibit A, which includes a detailed site plan, lighting plan and boundary <br />survey). <br />• There shall be no practice for hire on the site of the Lee County Mud Motorsports <br />Complex. <br />Land Uses Permitted: <br />• Land uses within the Lee County Mud Motorsports Complex zoning district shall include <br />a mud motor sports complex and all land uses currently allowed in the Residential <br />Agricultural District, and listed in Table 4.6-1 of the Unified Development Ordinance <br />(Exhibit B). <br />
