B K 00025 PG INTERLOCAL AGREEMENT WHEREAS, pursuant to N.C.G.S. Chapter 160A, Article 20, Part 1, this Interlocal Agreement (hereinafter "Agreement "), is entered into by and between the Town of Broadway, a body politic and a municipal corporation located in Lee County, NC (hereinafter "Municipality"), the County of Lee, North Carolina, a body politic and corporate (hereinafter "County"); and, WHEREAS, Municipality desires for County, by and through County's appointed Tax Collector, to collect current and delinquent municipal taxes by methods set forth in Chapter 105, Article 26 of the North Carolina General Statutes; and, WHEREAS, Town, by action of its City Council, requests that County collect current and delinquent ad valorem municipal property taxes and delinquent special assessments; and, WHEREAS, County, by action of the Board of Commissioners, has agreed to collect current and delinquent municipal taxes for Municipality; and, WHEREAS, Municipality and County have reached an agreement concerning the collection of current and delinquent ad valorem property taxes and delinquent special assessments, the terms and conditions of which are set forth below. NOW THEREFORE BE IT RESOLVED, in furtherance of this agreement, promises herein contained, payment hereinafter mentioned and the mutual benefits to result therefrom, Municipality and County agree to the following terms and conditions: 1. TERM. This agreement shall be in effect from July 1, 2013 until June 31, 2014 and shall renew automatically thereafter unless terminated in the manner prescribed below. 2. COUNTY DUTIES. County shall bill and collect current and delinquent Municipality property taxes and solid waste fees, excluding motor vehicles. 3. COMPENSATION. For the billing and collection of Municipality property taxes and solid waste fees, excluding motor vehicles, Municipality agrees to pay to County one and one -half percent (1.59'x) of the amount collected. County agrees to review this fee annually and to notify Municipality of any increases or decreases by December 1 prior to the July 1 effective date. County will provide to Municipality a scroll after each applicable running of bills that shows the number of bills prepared. A separate bill will be prepared showing the amount due to the County. The Municipality shall remit payment to County within thirty (30) days of receipt of such billing report.
