0 BOOK 20 nGE 869 <br />SECTION 3: COMPLIANCE WITH OTHER LAWS <br />Any person granted a franchise hereunder shall, as the condition of the franchise, <br />comply with the Lee County Solid Waste Ordinance and any other Lee County <br />ordinances which now or hereafter relate thereto and with all laws, rules and regulations <br />of the State of North Carolina and the United States of America with respect to the <br />operation of the particular sanitary landfill for which a franchise may be granted pursuant <br />to this Ordinance. <br />SECTION 4: FEES <br />The Board shall approve all fees to be charged by the operator of a sanitary landfill not <br />operating at the time of the adoption of this Ordinance or not otherwise subject to <br />existing contract terms as of the date of this Ordinance. The fees to be charged by any <br />such operator may be changed by the Board as it deems necessary or expedient. Such <br />sanitary landfill operator shall submit any proposed fee changes to the Clerk to the <br />Board for transmittal to the Board at least sixty (60) days prior to the proposed effective <br />date of the fee changes. <br />SECTION 5: TERM <br />A franchise shall be for a term of years not to exceed the maximum allowable by law at <br />the time of the filing of a franchise application pursuant to this Ordinance. Provided, <br />however, that any franchise granted hereunder shall not be for a term less than five (5) <br />years. Any person who has been granted a franchise for a sanitary landfill hereunder <br />shall be subject to the provisions and requirements of the Ordinance. <br />SECTION 6: TERMINATION/SUPSPENSION OF FRANCHISE <br />The Board may terminate or suspend, upon notice and hearing, all or any portion of a <br />franchise granted hereunder for any of the following reasons: <br />1. Failure of the operator to comply with the authorized fee schedule; <br />2. Failure of the operator to comply with any provision of this Ordinance, and franchise <br />document issued in connection herewith, or any regulations of the Department of the <br />United States of America which are applicable to a sanitary landfill operated pursuant <br />to the proposed or requested franchise; <br />3. Failure of the operator to comply with any applicable provision of the Lee County <br />Solid Waste Ordinance or of any Lee County Recycling Ordinance, now or hereafter <br />enacted; <br />4. Failure of the operator to comply with provisions of CERCLA/SARA or RCRA which <br />are applicable to a sanitary landfill operated pursuant to the proposed or requested <br />franchise; or <br />5. Falsification of any information in the application for a franchise. <br />5 <br />
