BOOK <br />STATE OF NORTH CAROLINA <br />COUNTY OF LEE <br />22 Face 993 <br />INTERLOCAL CONTRACT <br />FOR 911 <br />THIS CONTRACT, made and entered into this day of i. 2009, by <br />and between the City of Sanford, N.C. (hereinafter referred to as ty"), a North <br />Carolina municipal corporation and the County of Lee (hereinafter referred to as <br />"County"), a body both corporate and politic and one of the one hundred counties of the <br />State of North Carolina, <br />WHEREAS, a monthly 911 service charge is imposed on each active voice <br />communications service connection that is capable of accessing the 911 system; and the <br />service charges is payable by the subscriber to the voice communications service provider <br />and must be remitted by the provider to the State's 911 Board; and <br />WHEREAS, the City of Sanford Police Department is designated as the primary <br />Public Safety Answering Point (PSAP), the first point of reception of a 911 call, and <br />under the current legislation, the State's 911 Board must make monthly distributions to <br />the primary PSAP's from the amount allocated to the 911 Fund for PSAP's; and <br />WHEREAS, since the inception of 911 charges, the City has been the PSAP and <br />the County has collected the 911 funds and distributed the money to the City to pay the <br />eligible expenses of the PSAP, and has reported the funds to the State Treasurer and <br />audited the funds; and <br />WHEREAS, the State 911 Board has insisted that the City and County produce a <br />contract before they will release the 911 funds. <br />WITNESSETH: <br />For the purposes and subject to the terms and conditions herein set forth, the City <br />wishes for the County to continue to collect 911 surcharge funds on behalf of the city's <br />PSAP and disburse the funds to the City for the eligible expenses of the PSAP; and to <br />report those amounts to the state treasurer and audit those funds; and the County wishes <br />for the City to be the primary public safety answering point for public safety response to <br />911 calls and the County is willing to receive 91 1 surcharge funds from the State 911 <br />Board, on behalf of the City's PSAP; <br />NOW, THEREFORE, FOR AND IN CONSIDERATION of the promises <br />contained herein and other good and valuable consideration; the receipt and sufficiency <br />of which are hereby acknowledged, the parties hereto agree as follows: <br />L Eligibility for 911 Funding. As the Primary Public Safety Answering Point <br />(PSAP) the City is eligible to receive monthly disbursements of 911 funds <br />from the State 911 Board. <br />
