26 <br />Lee County Department of General Services <br />805 S. Fifth Street <br />Sanford, NC 27330 <br />ATTN: Solid Waste Superintendent <br />6. Company Covenants <br />(a) The Company will perform the Services in a fair and efficient manner and in <br />compliance with all applicable laws. <br />(b) The Company will be responsible for obtaining and maintaining all permits or <br />licenses required for the operation of its business in the County and the State of North <br />Carolina. <br />(c) The Company will not discriminate against any employee or applicant because of <br />race, color, creed, national origin, sex, age or ancestry. <br />7. Company Breach — In the event the County reasonably determines that the Company is <br />in breach of any of its obligations hereunder, the County may send written notice of <br />such breach to the Company. The Company will have thirty (30) days within which to <br />cure such breach or, if the breach will take longer than thirty (30) days to cure, to <br />implement reasonable measures to cure such breach. If the breach is not cured within <br />such period (or if reasonable measures to cure have not been undertaken), the County <br />may terminate this Agreement and retain all remedies available at law or in equity. In <br />the alternative, if the Company reasonably objects to the claim of breach, the Company <br />will respond in writing to the County within fifteen (15) days of receipt of the notice of <br />breach with its justification for objection. The parties will work in good faith to resolve <br />such dispute within thirty (30) days thereafter. <br />8. Complaints - The Company, or its authorized representative, shall be readily accessible <br />to the County's Solid Waste Superintendent, or his /her authorized representative, in <br />order that all efforts will be made to resolve any and all disputes and complaints arising <br />out of performance of any services provided under this Agreement. <br />9. Performance Bond — Within fifteen (15) days after the signing of this Agreement, the <br />Company shall furnish to the County a performance bond with a company surety in the <br />amount equal to twenty -five per cent (25 %) of the annual Agreement sum, which shall <br />be conditioned upon faithful performance of each and every term, condition, and <br />provision of the Agreement and shall be approved by the Lee County Attorney.
