BOOK 20 PAC 28 <br />LEE COUNTY <br />Committed Today for a Better Tomorrow <br />RESOLUTION <br />WHEREAS, the State Board of Elections (SBOE), acting pursuant to the Public <br />Confidence in Elections Act (SB223) enacted by the General Assembly, has decertified <br />all voting equipment that does not meet Federal and State mandates; and <br />WHEREAS, Lee County in 2002 spent $428,127.04 to acquire SBOE approved voting <br />machines which then met Federal mandates and still does; and <br />WHEREAS, SB223 was ratified on August 16, 2005, which was after counties had to <br />adopt their budget for the Fiscal Year July 1, 2005 to June 30, 2006, according to <br />General Statutes; and <br />WHEREAS, the paper trail requirement in SB223 is the reason the present voting <br />machines owned by Lee County were decertified; and <br />WHEREAS, the SBOE received its list of certified vendors and equipment on December <br />1, 2005, and gave counties until January 20, 2006, to order new voting machines. <br />Since then one of the two certified vendors has withdrawn its product, leaving only one <br />certified vendor; and <br />WHEREAS, the Board of Commissioners is of the opinion that the General Assembly <br />did not provide enough funds or enough time for counties to address the problems and <br />the expense of meeting the requirements of SB223. <br />NOW, THEREFORE, The Board of Commissioners of Lee County does hereby <br />resolve to respectfully request his Excellency, the Honorable Michael F. Easley, <br />Governor of the State of North Carolina, to call a special session of the North Carolina <br />General Assembly to delay implementation of Senate Bill 223. <br />Adopted this the 3`d day of January 2006.
