0 0 <br />BOOK 21 PAGE 775 <br />b) Terminate Tenant's right to possession of the Premises, thereby terminating this <br />Lease, and recover as damages from Tenant: <br />1. The worth at the time of award of the unpaid rent which had been <br />earned at the time of termination of this Lease; <br />2. The worth at the time of award of the amount by which the unpaid <br />rent which would have been earned after termination of the Lease <br />until the time of award exceeds the amount of rental loss that <br />Tenant proves could have been reasonably avoided; <br />3. The worth at the time of award of the amount by which the unpaid <br />rent for the balance of the term after the time of award exceed the <br />amount of rental loss that Tenant proves could be reasonably <br />avoided, <br />4. Any other amount necessary to compensate Landlord for all <br />detriment proximately caused by Tenant's failure to perform its <br />obligations under this Lease; or <br />c) In lieu thereof, or in addition thereto, bringing an action for any or all of the <br />recoveries described in subparagraph (b), bring an action to recover and regain <br />possession of the Premises in the manner provided by the law of unlawful <br />detainer then in effect in the State of North Carolina. <br />21. SURRENDER OF LEASE. The voluntary or other surrender of this Lease by Tenant, or <br />mutual cancellation thereof, shall not cause a merger at law and shall, at the option of <br />the Landlord, terminate all and any existing subleases or subtenancies, or may, at the <br />option of the Landlord, operate as an assignment of any and all such subleases or <br />subtenancies to Landlord. <br />22. NOTICE All notices and consents required or permitted under this Lease shall be given <br />in writing and delivered in person or by United States mail, by certified or registered mail, <br />return receipt requested, in which case it shall be deemed delivered two (2) days after <br />deposit in the U.S. mail. Notice to the Landlord, if mailed, shall be addressed as follows: <br />LEE COUNTY <br />c/o County Manager <br />Lee County Government Center <br />106 Hillcrest Drive <br />P.O. Box 1968 <br />Sanford, NC 27331-1968 <br />Notice to the Tenant, if mailed, shall be addressed as follows <br />CENTRAL CAROLINA HOSPITAL <br />1135 Carthage St. <br />Sanford, NC 27330 <br />and a courtesy copy to: <br />Tenet Health System - Law Department <br />Centre Square 34W <br />1500 Market Street <br />13 <br />
