Box 1968 <br />Sanford, NC 27331-1968 <br />e) If any rent or other payment under this Lease is not paid when due, it shall bear <br />interest at a rate of ten percent (10%) per annum until paid, and in addition the <br />rental payment shall be subject to a Twenty-Five Doilar (525.00) late service <br />charge per month if not paid on or before the tenth (10..') day of each month. <br />However, this provision shall not relieve Tenant from any default. <br />f) If applicable in the jurisdiction where the premises are situated, Tenant shall pay <br />and be liable for all rental, sales and use taxes or similar taxes, if any, levied or <br />imposed by any city, state, county, or other governmental body having authority, <br />such payments to be in addition to all other payments required to be paid to <br />Landlord by Tenant under the terms of this Lease. Any such payment shall be <br />paid concurrently with the payment of the Rent upon which such tax is based. <br />4. ADDITIONAL RENT. All personal property taxes, charges, costs, and expenses that <br />Tenant assumes or agrees to pay hereunder, together with all interest and penalties that <br />may accrue thereon in the event of failure of Tenant to pay those items, and all other <br />damages, costs, expenses and sums that Landlord may suffer or incur, or that may <br />become due, by reason of any default of Tenant or failure by Tenant to comply with the <br />terms and conditions of this Lease shall be deemed to be additional rent, and in the <br />event of nonpayment, Landlord shall have all rights and remedies as herein provided for <br />failure to pay rent. <br />5. USE OF PREMISES. <br />a) Tenant shall use and occupy the Premises throughout the term of the Lease <br />solely for the purpose of operating and maintaining an ambulance service to <br />provide emergency and non-emergency medical services for the people living in <br />Lee County and adjacent areas. Any other use of the premises without <br />Landlord's approval shall constitute a breach of this Lease. Tenant recognizes <br />that these restrictions on the use of the Premises are a material consideration for <br />Landlord to enter into this lease. <br />b) Tenant shall comply with all laws, ordinances, rules, regulations and codes of all <br />municipal, county, state, and federal authorities pertaining to the use and <br />occupation of the Premises. Tenant shall neither use nor occupy the Premises <br />or any part thereof for any illegal, unlawful, dangerous, or hazardous purpose, <br />nor shall it conduct its operations in a manner which would constitute a nuisance <br />of any kind. <br />6. ENVIRONMENTAL COMPLIANCE/HAZARDOUS MATERIALS. <br />a) Definitions. "Hazardous Materials" shall mean any material, substance or waste <br />that is or has the characteristic of being hazardous, toxic, ignitable, reactive or <br />corrosive, including, without limitation, petroleum, PCB's, asbestos, materials <br />
