BOOK 21 PAGE 706 Amendment No. 1 to Operating Agreement Y41 THIS AMENDMENT No. 1, is entered into this day of 2007 by and between County of Lee, North Carolina ("COUNTY"), The Enrichmen Center of Lee County, ('CENTER") and ARAMARK Correctional Services, LLC, formerly ARAMARK Correctional Services, LLC, a Delaware limited liability company, formerly ARAMARK Correctional Services, Inc, with offices located at the ARAMARK Tower, I101 Market Street, Philadelphia PA 19107 ("ARAM-ARK"). WITNESSETH: WHEREAS, the parties did, on May 31, 2006, enter into an Agreement for the food services operation for participants at the CENTER at Lee County Jail, (hereinafter the "Agreement"); and WHEREAS, the parties desire to amend said Agreement as hereinafter set forth, effective July 1, 2007. NOW, THEREFORE, in consideration of the foregoing and of the mutual promises in said Agreement, it is mutually agreed as follows: 1. Pursuant to Paragraph 5, Term of Agreement, the term of the Agreement shall be renewed for a one (1) year period, effective from July 1, 2007 through June 30, 2008. 2. Pursuant to Paragraphs 5A and 513, the price per meat charged to the COUNTY by ARAMARK shall be changed as a result of changes in the Consumer Price Index and are set forth in Attachment A. These prices shall be effective as July 1, 2007 and shall remain firm through June 30, 2008. 3. The following shall be added to Paragraph 313, "FINANCIAL ARRANGEMENTS" of the Agreement: "(B) BILLING AND PRICES: ARANIARK will provide, at no additional cost, a facto- ovo vegetarian and/or vegan diet for all religious requests from the administrative or religious authority. Other religious meals requested by the administrator or religious authority, such as prepackaged meals, shall be provided at a price to be mutually agreed in advance." 4. 'The following shall beadded to the Agreement as Paragraph 14, "ASSIGNMENT": "14. ASSIGNMENT: ARAMARK may not assign this Agreement without the COUNTY'S prior written consent., except that ARAM1VZK may assign this Agreement to an affiliate without consent being requirccl.
