RK PG-0476 <br />6. Inspection <br />Landlord, or its authorized agents, shall at any and all reasonable times, after three (3) days' <br />notice, have the right to enter the premises to inspect the same. <br />7. Taxes <br />Tenant shall be liable for all personal property taxes levied against leasehold improvements, <br />merchandise, personal property, trade fixtures and all other taxable property located in the <br />premises. <br />Landlord shall be liable for all real property taxes levied against the property. <br />S. Repairs and Maintenance <br />Tenant shall be responsible for the maintenance of the interior and the janitorial service of <br />the premises. <br />Landlord shall be responsible for all structural, mechanical, plumbing and exterior <br />maintenance, including but not limited to maintenance of windows, doors and door <br />mechanisms, HVAC, fire suppression system and annual inspection of backflow prevention, <br />toilet facilities, roof, and gutters. Landlord shall be further responsible for landscaping, if <br />any, and all parking lot repairs and maintenance. <br />9. Tenant Damages <br />Tenant shall not allow any damage to be committed on any portion of the premises or <br />property, and upon termination of this lease, Tenant shall deliver the premises to Landlord <br />in as good condition as existed at the commencement date of this Lease, ordinary wear and <br />tear excepted. The cost and expense of any repairs necessary to restore the condition of the <br />premises shall be borne by Tenant. <br />10. Force Maieure <br />If the leased premises are destroyed by fire or other casualty without fault of the Tenant, <br />this lease shall immediately terminate and the rent shall be apportioned to the time of the <br />damage. If the premises are only partially destroyed or damaged by fire or other casualty <br />without fault of the Tenant so as to render the premises unusable in whole or in part, the <br />rent shall be apportioned until the premises are repaired. <br />M Payment <br />Other remedies for nonpayment of rent notwithstanding, if any payment of rent or <br />additional rent is not received by Landlord on or before the fifth (5 day of the month for <br />which the rent is due, or if any other payment hereunder due Landlord by Tenant is not <br />received by Landlord on or before the fifth (5 day of the month next following the month <br />in which Tenant was invoiced, Tenant shall also pay (a) a late payment charge of ten percent <br />(10%) of such past due amount, and (b) interest of eighteen percent (18 %) per annum or the <br />maximum then allowed by applicable laws, whichever is less, on the remaining unpaid <br />balance, retroactive to the date originally due until paid. <br />12. Holdine Over <br />If Tenant does not vacate the premises upon the expiration or earlier termination of this <br />lease, Tenant shall be a tenant at sufferance on a month -to -month basis and all of the terms <br />
