A4
,, reafive
• At this time, most of Lee County's available sites are relatively small and will attract
companies that may not meet the investment threshold. This puts assets at odds with the
incentive policy. If Lee County had very good, very large sites, then a policy that focused
on larger projects may be practical. However, at this time, this threshold does not match
with the current inventory of product.
Clause 7
"Any Company receiving an incentive must commit to continue operations, without seasonal
variations that cause its number of jobs to fall below required levels, for the duration of the
incentive period."
• State programs typically require an annual (or quarterly) reporting of employment to
ensure that job creation commitments are met.
Clause 8
"Economic incentives will not be offered in advance of business investment or job creation in
Lee County."
• I assume it means to say "will not be paid upfront or in advance of... ". The offer must be
made and accepted as part of the required "but for" imperative of incentives.
Clause 9
"The County will review requests for public infrastructure which benefit the business and the
entire community as an alternative to incentives."
• These types of incentives should be emphasized by the policy. Often a large part of the
total incentive package is things other than cash grants.
Clause 10
"All incentives shall be paid pursuant to a written incentive agreement between Lee County and
the recipient business. Provisions shall be included in every incentive agreement to ensure the
county, pursuant to NCGS 158- 7.1(h), recaptures sums appropriated or expended by the county
in the event the business fails to adhere to its job creation, investment, and continuous operations
agreements at any time during the contract period."
• Consistent with other policies.
Clause 11
"Clawback provisions may include termination of the contract, proration of future incentive cash
payouts, and/or repayment of incentives already issued to a business."
• Consistent with other policies.
Creative Economic Development Consulting, LLC
PO Box 706, Elkin, NC 28621 • 336 - 526 -1332 • www.creativeedc.com
