r :`7 <br />U `) <br />review total investment of real versus personal property before <br />granting an incentive. <br />4) Any Company receiving an incentive must commit to continue <br />operations for the duration of the incentive period. <br />5) In Lieu of cash incentives the County will review requests for public <br />infrastructure which benefits not only the industry but the entire <br />community as an alternative means of incentives for a company. <br />6) Failure to meet all incentive contract requirements will result in the <br />enforcement of claw -back provisions which will include proration of <br />incentive cash payouts and /or the required payback of incentives <br />already issued to a company. <br />NOW BE IT FURTHER RESOLVED, that the guidelines listed above are <br />not intended to be entitlements for industry or business to receive incentives from <br />Lee County. The County reserves to the right to review all proposals and <br />recommendations for or against incentive offers by the LCEDC and to make the <br />final decision on incentive awards on the basis of what is in the best interest for <br />the citizens of Lee County. All incentives are subject to Public Hearing and vote <br />of the County Commissioners as required by law. <br />The Board of Commissioners instructs the County Attorney to review all <br />contract documents and change them to reflect the new policy of the Board of <br />Commissioners.
