<br />AMENDMENT TO
<br />TAX FORECLOSURE ATTORNEY AGREEMENT
<br />EXTENDING TERM
<br />This agreement, made and entered into this the day of r , 2013,
<br />by and between Lee County, hereinafter referred to as County, and Mar D. Bard P.C., a
<br />North Carolina professional corporation, hereinafter referred to as Attorney, shall be for the
<br />legal services to be provided for foreclosure actions on delinquent real property taxes due to the
<br />County, and to this end, the parties hereto make the following recitals:
<br />WITNESSETH:
<br />WHEREAS, Attorney and Lee County entered into an agreement for legal services on
<br />August 17 , 2008, the period of time that has become known as the Great Recession; and
<br />WHEREAS, during this period, Attorney and the Lee County Tax Office have
<br />administered the Lee County Tax Foreclosure program; and
<br />WHEREAS, during this period, the Lee County Tax Foreclosure Program has collected
<br />in excess of Two Million Five Hundred Thousand Dollars ($2,500,000) in delinquent revenue
<br />without dispossessing a single Lee County property owner of their personal residence; and
<br />WHEREAS, during this period, the Lee County Tax Foreclosure Program has resulted
<br />in only eight parcels being purchased by the County, thereby avoiding a substantial increase in
<br />the surplus properties being held by the County; and
<br />WHEREAS, Attorney currently serves as Special Tax Attorney for the Counties of
<br />Onslow, Jones, Craven, Lenoir, Beaufort, Wilson, Warren, Chatham, Lee, Cabarrus, Scotland,
<br />Tyrrell, Forsyth, Yadkin, Yancey, Iredell and Gates and the Towns of Jonesville, Wallace,
<br />Columbia, Rose Hill, Yadkinville and East Bend; and
<br />WHEREAS, Attorney is the only firm that exclusively provides tax foreclosure services
<br />in its practice of law, with staff, facilities and other resources dedicated solely to the service of
<br />local government in this area of law; and
<br />WHEREAS, tax foreclosure law is a certain and special area of practice and any
<br />attorney who serves as a Special Tax Attorney must provide specially trained staff, must
<br />advance thousands of dollars in costs and must dedicate other resources in order to successfully
<br />complete the foreclosure assignments made to it; and
<br />WHEREAS, to support these specially trained staff, advanced costs and other dedicated
<br />resources, Attorney needs a contract with County to serve as its special tax attorney for an
<br />extended term of four (4) years; and
<br />WHEREAS, the current contract has served the parties hereto well and should be
<br />extended for an additional four (4) year term but at this time, County and the City of Sanford
