BRITT <br /> REGISTER OF DEEDS <br /> FILED Mar 04, 2025 <br /> AT 09:19:52 am <br /> BOOK 00004 <br /> START PAGE 0095 <br /> END PAGE 0095 <br /> INSTRUMENT # 01321 <br /> EXCISE TAX (None) <br /> Resolution Approving a Brand Specific Chiller for the <br /> Lee County Courthouse Chiller Replacement Project <br /> Whereas, currently, there are two 115-ton chillers located at the Lee County Courthouse and the Lee <br /> County Board of Commissioners has budgeted in the FY2024-2025 budget for General Services to <br /> replace one of the 115-ton chillers: and <br /> Whereas,the two 115-ton chillers are manufactured by YORK; and <br /> Whereas,North Carolina General Statute 133-3 governs when a preferred brand alternate is necessary for <br /> a project,the owner must approve the preferred alternate when it will provide cost savings, maintain or <br /> improve the functioning process or system affected by the preferred item and there is a justification of <br /> these criteria to the public,and <br /> Whereas, General Services is replacing one of the 1 15-ton YORK chillers located at the courthouse and to <br /> ensure compatibility and for cost-savings of maintenance, General Services is requesting bid <br /> specifications to allow for YORK preferred brand alternates in the bid documents. <br /> Now, Therefore Be it Resolved by the Board of Commissioners, the following: <br /> 1. The bid specifications to replace one of the 115-ton chillers at the courthouse for FY2024-2025. <br /> can include a brand specification alternate for YORK manufactured chillers based on the cost <br /> savings and to improve functioning of the current system, as detailed in the attached letter from <br /> General Services. <br /> 2. The performance standards should include a functioning I I5-ton chiller with a system sufficient <br /> to heat and cool the Lee County Courthouse and as further described in the bid specification <br /> documents. <br /> 3. The bid document should include a deadline for bidders to submit items of equal or equivalent <br /> design to the brand alternate for approval or disapproval by the engineer. The engineer will <br /> approve or disapprove any substitute items submitted by bidders and notify them of their approval <br /> or disapproval, before bid opening.
