i 9 A. FOR THE FISCAL YEAR ENDING JUNE 30, 2012 If this interlocal agreement is executed and delivered by each party, then the County shall include in its Fiscal Year 2011 -2012 budget ordinance a special restricted appropriation to the School Board in the amount of $500,000.00 (FIVE HUNDRED THOUSAND DOLLARS). The appropriation will be made upon the following terms and conditions. 1. The Board of Commissioners agrees to allocate the special restricted appropriation and the Board of Education agrees to reduce expenditures throughout the categories available to match $400,000.00 (FOUR HUNDRED THOUSAND DOLLARS) of the appropriation. 2. The $400,000-00 (FOUR HUNDRED THOUSAND OLLARS)LofRt matching and $400,000.00 he special d appropriation, for a total of $800,000.00 (EIGHT HUNDRED THOUSAND DOLLARS), may be used only to pay the salaries, local supplements, and employer's portion of benefits costs and taxes for teacher's assistants. 3. The remaining $100,000.00 (ONE HUNDRED THOUSAND DOLLARS) of the special restricted appropriation may be used only to pay the wages and employer's portion of taxes for tutors in a total number not to exceed the total number of tutor positions funded by the School Board in its Fiscal Year 2010 -2011 budget and to support the Graduation Ambassador Program. The hourly rate of pay for these tutors shall be no greater than was paid in Fiscal Year 2010 -2011. 4. The parties agree that the special restricted appropriation is to be used exclusively for the specific purposes described herein and no other. The School Board agrees to not transfer any amount of the special restricted appropriation to another purpose or function budget code without the expressed consent of the Lee County Board of Commissioners as authorized by a resolution adopted by a majority of the Board. 5. If at any time during the term of this Agreement, the State of North Carolina reduces or eliminates the discretionary reduction, also referred to as the LEA Adjustment and does not decrease other state funding categories as identified In the Appropriations Act of 2011 (Session Law 2011 -145) or the School Board receives additional funding from any other source that may be used to fund these current operations expenses, then the School Board will pay back to the County' an amount equal to the reduction in the LEA adjustment or the additional funds it receives that could have been used to fund these current operations expenses, up to the full amount of the County's special, restricted appropriation of $500,000.00 (FIVE HUNDRED THOUSAND DOLLARS), regardless of whether the School Board actually uses the additional funds to pay for these specific current operations expenses. 2
