i 9 <br />A. FOR THE FISCAL YEAR ENDING JUNE 30, 2012 <br />If this interlocal agreement is executed and delivered by each party, then the County <br />shall include in its Fiscal Year 2011 -2012 budget ordinance a special restricted appropriation <br />to the School Board in the amount of $500,000.00 (FIVE HUNDRED THOUSAND DOLLARS). <br />The appropriation will be made upon the following terms and conditions. <br />1. The Board of Commissioners agrees to allocate the special restricted <br />appropriation and the Board of Education agrees to reduce expenditures throughout <br />the categories available to match $400,000.00 (FOUR HUNDRED THOUSAND DOLLARS) <br />of the appropriation. <br />2. The $400,000-00 (FOUR <br />HUNDRED THOUSAND OLLARS)LofRt matching <br />and $400,000.00 he special d <br />appropriation, for a total of $800,000.00 (EIGHT HUNDRED THOUSAND DOLLARS), may <br />be used only to pay the salaries, local supplements, and employer's portion of benefits <br />costs and taxes for teacher's assistants. <br />3. The remaining $100,000.00 (ONE HUNDRED THOUSAND DOLLARS) of the <br />special restricted appropriation may be used only to pay the wages and employer's <br />portion of taxes for tutors in a total number not to exceed the total number of tutor <br />positions funded by the School Board in its Fiscal Year 2010 -2011 budget and to <br />support the Graduation Ambassador Program. The hourly rate of pay for these tutors <br />shall be no greater than was paid in Fiscal Year 2010 -2011. <br />4. The parties agree that the special restricted appropriation is to be used <br />exclusively for the specific purposes described herein and no other. The School Board <br />agrees to not transfer any amount of the special restricted appropriation to another <br />purpose or function budget code without the expressed consent of the Lee County <br />Board of Commissioners as authorized by a resolution adopted by a majority of the <br />Board. <br />5. If at any time during the term of this Agreement, the State of North Carolina <br />reduces or eliminates the discretionary reduction, also referred to as the LEA <br />Adjustment and does not decrease other state funding categories as identified In the <br />Appropriations Act of 2011 (Session Law 2011 -145) or the School Board receives <br />additional funding from any other source that may be used to fund these current <br />operations expenses, then the School Board will pay back to the County' an amount <br />equal to the reduction in the LEA adjustment or the additional funds it receives that <br />could have been used to fund these current operations expenses, up to the full <br />amount of the County's special, restricted appropriation of $500,000.00 (FIVE <br />HUNDRED THOUSAND DOLLARS), regardless of whether the School Board actually uses <br />the additional funds to pay for these specific current operations expenses. <br />2 <br />
