STATE OF NORTH CAROLINA COUNTY OF LEE INTERLOCAL AGREEMENT TO PROVIDE A SPECIAL RESTRICTED APPROPRIATION TO THE LEE COUNTY BOARD OF EDUCATION FOR THE PURPOSES OF FUNDING TEACHER'S ASSISTANTS AND TUTORS SALARIES AND THE GRADUATION AMBASSADORS PROGRAM DURING FISCAL YEARS 2011 -2012 AND 2012 -2013 THIS AGREEMENT, made and entered into thiaS day of 2011, by and between the COUNTY OF LEE, one of the counties of the State of North Caroli and a body politic and corporate (hereinafter referred to as the "County) and the LEE COUNTY BOARD OF EDUCATION, a body corporate, (hereinafter referred to as the "School Board ') WITNESSETH: WHEREAS, the School Board has control and supervision of all matters pertaining to the public schools in the County; and, WHEREAS, the County is a unit of local government with responsibility for appropriating sufficient funds for the current operating expenses of the county schools and, therefore, may use local revenues to add to or supplement any public school or post- secondary school program; and, WHEREAS, the School Board is of the opinion that it will not have sufficient funds in Fiscal Years 2011 -2012 and 2012 -2013 to employ an appropriate number of teacher's assistants and tutors; and, WHEREAS, the School Board is of the opinion that it will not have, sufficient funds in Fiscal Years 2011 -2012 and 2012 -2013 to support the Graduation Ambassador Program at an appropriate level; and, WHEREAS, the County is convinced that it should exercise, in its discretion and as authorized by Section 2, Article IX of the North Carolina Constitution, its authority to add to or supplement federal, state and other funding for teacher's assistants' salaries, tutors' wages and the Graduation Ambassadors Program in Fiscal Years 2011 -2012 and 2012 -2013 at an appropriate level; and, WHEREAS, the School Board is appreciative of any supplemental financial assistance the County deems appropriate to provide over and beyond the amount of its constitutional and statutory obligations and recognizes such support will be provided as a matter of discretion and not as a requirement of law; or as an increase in the base of the local operations fund for the Lee County Schools. NOW THEREFORE, for and in consideration of the premises hereto and other good and valuable consideration, the parties agree as follows:
