BRITT <br /> REGISTER OF DEEDS <br /> FILED Oct 17, 2024 <br /> AT 02:06:14 pm <br /> BOOK 00004 <br /> START PAGE 0065 <br /> END PAGE 0065 <br /> INSTRUMENT # 06572 <br /> EXCISE TAX (None) <br /> RESOLUTION DELEGATING AUTHORITY TO THE COUNTY MANAGER <br /> TO SETTLE CERTAIN LAWSUITS AND EXECUTE DOCUMENTS <br /> WHEREAS,the Lee Board of County Commissioners pursuant to N.C.Gen.Stat.§ 153A-11 has the <br /> power to sue and be sued,and the authority to settle,approve and sign legal settlements involving the <br /> County, its Elected Officials,employees,agents or entities and to execute documents related to such <br /> settlement; <br /> WHEREAS,the County Manager is the chief administrator of Lee County pursuant to N.C.Gen.Stat.§ <br /> 153A-82(a)and is involved in the daily workings of the County; <br /> WHEREAS,some legal suits and settlements require no monetary payments from the County,or <br /> require payments to the County or require minimal monetary payments to another party for settlement; <br /> WHEREAS,the Board is of the opinion that it is in the best interest of the County to delegate to the <br /> County Manager the power and authority to authorize the County Attorney to file a lawsuit in cases that <br /> involve relief other than monetary payment or that involve payments to be received by the County in any <br /> amount or that involve settlement payments to another party less than or equal to$30,000.00; and <br /> WHEREAS,the Board is of the opinion that it is in the best interest of the County to delegate authority <br /> to the County Manager to approve,settle and sign legal settlement agreements and court orders on behalf of <br /> the County in cases that involve relief other than monetary payment or that involve payments to be received <br /> by the County in any amount or that involve settlement payments to another party less than or equal to <br /> $30,000.00; <br /> NOW THEREFORE, BE IT RESOLVED by the Lee County Board of County Commissioners as follows: <br /> 1. That the County Manager is hereby delegated the authority to authorize the County Attorney to <br /> file a lawsuit in cases that involve relief other than monetary payment or that involve payments to <br /> be received by the County or that involve settlement payments to another party less than or <br /> equal to$30,000.00. <br /> 2.
