0 BOOK 21 PAGE 46G <br />LEE COUNTY <br />Committed Today for a Better Tomorrow <br />February 21, 2007 <br />Representative Jimmy Love, Sr. <br />315 McIntosh Street <br />Sanford NC 27330 <br />Re: Lee County Local Option Sales Tax Bill <br />Dear Representative Love: <br />In response to the questions from Mr. Ettefagh of Legislative Drafting, please <br />advise him as follows: <br />1. Exempt food taxes as set out in Representative Sauls Bill; <br />2. Allow the tax to continue indefinitely until the Board of <br />Commissioners chooses to end the additional tax; <br />3. Have the revenue generated by the additional tax to be limited to <br />use for capital improvements for the public schools and community <br />college and debt retirement for previous improvements at both the <br />public schools and community college; <br />4. The Board would prefer to be able to impose the tax without a <br />referendum but do not object to the language drafted by <br />Representative Sauls labeled as "§105-536 Limitations" and "§105- <br />537 Levy". The Commissioners are aware that the House Select <br />Committee on Public School Construction in its final <br />recommendation stated that the tax would have to be approved by <br />referendum. If that is what is required to secure passage, the <br />Commissioners had rather accept that than lose adoption of the <br />Bill; and <br />5. Likewise with respect to the amount of the tax, Commissioners <br />would like a one-cent sales tax but if the recommendation of the <br />Select Committee of only a half-cent is all that is attainable the <br />Board will accept it. <br />The Board noted that the Select Committee rejected a proposal that would <br />authorize counties to impose Impact Fees and Land Transfer Taxes for school <br />construction needs. If Bills are introduced to give counties such authority the <br />Board of Commissioners respectfully asks you to support the enactment of such <br />legislation. <br />OFFICE OF THE COUNTY ATTORNEY <br />P.
